Complaint agst. refuse to change/return the material

I have purchase a nubelizer machine on 28.11.09 vide cash memo no. 2765 for rs. 1400.00 when i open the machine at my home it was already used and unpacked. then i hv gone to the shop to return / replace the same. but he has refuse to return or replace the same and he used bad words agst. me.
