I, Dr. (smt) Rashmi Pathak, Advocate on my own behalf hereby serve you this notice to the following effects,
1. In the years 2003 you had released massive advertisements in the leading print & electronic media of the Country for the launching of “Sahara City Homes” launched in 217 (two hundred seventeen) cities and Jabalpur (M.P.) was one of the city for which the said scheme was launched by you.By this campaign of advertisement, you have invited general public of the India to deposit money for the booking of dwelling houses and in turn you accepted huge sum of money as advance for purchase of immovable property (Housing unit/Commercial unit) which has been termed by you “Booking Advance Amount” for the scheme of “Sahara City Homes” under “Sahara Swarn Yojana and Sahara Rajat Yojana”
2. That, at the time of launching of your housing schemes, with mala fide intensions, you managed to get adequate coverage in the leading newspapers of the Country for the above referred housing schemes which leads for you to deposit huge funds of the public.
3. That, to gather the attention of the general public of Jabalpur and nearby Districts you had erected a display board Near Gram Tewar, National Highway No. 12, Tahsil & District Jabalpur and propagated this location as proposed site for “Sahara City Homes”, spreading around 200 Acres and gave wide publicity for the same.
4. Having impressed from your advertisements released in leading news papers, looking to the location of proposed site, the lucrative features and prizes projected for the said “Sahara City Homes” Jabalpur, thousands of people of Jabalpur & nearby Districts have deposited handsome amount of money in multiple of one lacks or ten thousands under your scheme known as “Sahara Swarn Yojana” & “Sahara Rajat Yojana”.
5. That, the undersigned has also deposited Rs. 9844.00 (Nine thousand eight hundred forty-four) in “Sahara Rajat Yojana” vide your receipt No. 010068723875 dated 31/12 issued by Jabalpur sector office of yourself.
6. That, after depositing hard earned money of mine and many other peoples like me who had deposited money for the booking and purchasing the house under the said housing scheme at Jabalpur, you neither communicated with regard to status of the sahara city homes Jabalpur nor laid a single brick in past seven years at the proposed site of sahara city homes at Jabalpur (M.P.)
7. That, you have also blocked your official website of Sahara city homes for malafide intensions which is displaying message that the said website is “Under Renovation” since last many years.
8. That, I have also visited Jabalpur sector office of yourself many times to enquire the status of the project and of the house booked by me but you have always mis-leaded about the delivery and possession for the said house, even you have denied to provide statement of account, information regarding whereabouts of my deposited funds, names and addresses of Board of Directors of the company, project status report, information regarding sanctioned map for the project of sahara city homes Jabalpur, banker for the said project etc.
9. That, I have also personally visited the aforementioned proposed site of Sahara City Homes Jabalpur, and observed that the display board which had been erected by you earlier has looses its color and in past seven years no development or construction work has commenced so for, thus you have cheated general public in large for depositing huge sum of money in the name of your dream housing project and the undersigned is one of them.
10. That, in past seven years infrastructure sector has achieved tremendous growth and in result the value of residential and commercial plots and the cost of construction thereof have increased by many folds. You have accepted my money for the booking of dwelling house in sahara city homes, Jabalpur therefore I have not booked or purchased any other house in Jabalpur, thus you sustained me heavy loss by non delivery of house to me.
11. That, I have thoroughly investigated your above referred schemes which had been launched by you Nationwide for the dream housing project of yourself and found that lacks of people of country have been cheated by you by depositing their hard earned money for the said project and hundreds of people have left comments on the internet for the fraud and cheating committed by you with them. I have invested approx 3 Lakh in Sahara city homes. Like others i am also feeling cheated by Sahara Group. And to calculate the quantum of this FRAUD being done by Sahara - i tried this:
100000 Members
100000 Rs deposited by each member
So as on this date Sahara Group has managed to collect more than 1000 Crore Rupees at 8% interest which i believe they will not pay by making some stupid/ruthless excuses.
We people are being cheated by this group so badly and no body has raised his voice on higher level yet.
TV channels are found covering a fraud of Rs 10000 Rupees but they dont have the caurage to go after SAHARA group because SAHARA Group consists or lots of powerful Politicians and other powerful people including but not limited to Subrata Roy/Amar Singh and there are lots of other people involved. I fear Uttar Pradesh's top political leaders involvement in this fraud/cheating 420 case.
We all must group together to raise the voice.

SIMPLY THEY ARE MAKING FOOL & KEEP ON PROMISSIMG FALSE COMITMENTS AGAIN AND AGAIN... That, please be aware of the fact that the Madhya Pradesh Police has recently launched massive campaign against land mafia and builders who committed cheating and fraud with their customers and remain failed to fulfill their commitment. The police have also booked number of persons by registering FIR against them for their illegal affairs with regard to housing schemes.
13. That, it has also been further observed by me that many people of Country have preferred First Information Report (FIR) against the Company including the directors of the Company for the offence of Criminal Breach of Trust, Cheating, Fraud and Forgery committed by the you. It is further to submit that your unfair trade practice is also in violation of Housing Finance Company (NHB) Directions, National Housing Bank Act, 1987 & Reserve Bank of India Act, 1934 and the same is punishable offences under the said acts respectively.
14. That, your above described act is also punishable offence under section 403, 405, 406, 415, 417, 418, 420, 467, 468 and 120B of Indian Penal Code, 1860 and under section 36A of Monopolies And Restrictive Trade Practices Act, 1969 .
15. That, in view of the facts and the circumstances mentioned above you are hereby requested to provide the following information /documents,
a. Attested copy of my application form obtained by you through your agent Smt. Rekha Tiwari used for depositing the above referred advance booking amount of mine.
b. Attested copy of schemes referred above.
c. Attested copy of Balance Sheet and Profit & Loss Account along with Auditors Report for the last seven years of the Company.
d. Copy of sale deed / lease deed of the land proposed for the sahara city homes, Jabalpur (M.P.)
e. Attested copy of layout plan of sahara city homes, Jabalpur submitted by you to Town & Country Planning department/Gram Panchayat / Nagar Nigam/ M.P. Government for approval of Layout and the project.
f. Attested copy of project report of sahara city homes, Jabalpur submitted to your banker and provide name and address of your banker for the said scheme for Jabalpur.
g. Complete details of the funds collected by your Jabalpur sector office from the general public as booking advance amount for the proposed sahara city homes under sahara swarn and rajat yojana also provide complete details and quantum of funds so for deployed to develop the said project at Jabalpur.
h. Details of marketing agents/associated persons who mobilized deposits for you for the said project/scheme in Jabalpur under Jabalpur sector office of yourself.
i. Details about the Constitution of the Company, copy of Memorandum & Article of Association of Company and Credit Rating Certificate of the Company.
j. Whether the Company is registered as NBFC with Reserve Bank of India or not? Provide copy of registration of the Company with RBI and National Housing Bank.
16. You are hereby advised to provide the above referred information forthwith and simultaneously make arrangement to deliver possession of the residential house in sahara city homes Jabalpur on the price prevailing in the year 03, within fifteen days from the receipt of this notice failing which I shall register an FIR against you for the offences committed by you with me and many others people of the Country.
Please take notice and act accordingly, also arrange to remit Rs.5000.00 (Five thousand only) towards the cost of this notice.
