Defective item taken back but not replaced

Cheating by AVA Merchandising. Defective Steam Cooker taken back but not replaced.

I had placed an order on M/s AVA Merchandising, for a "Multi Steam Cooker" on 18.11.2007 over phone, payment was to be effected against my citibank credit card. I received the item on 30.11.2008 under Invoice No. ADV/16/44567/07-08 dt. 19.11.2007.

The item was found to be defective on first use and a complaint was sent on 07.12. delivered by the courier to them on 08.12.2007. After several reminders, M/s AVA merchandising responded on 14.01. seeking details of the credit card which was provided on 17.01.2008. I was further advised to hand over the item to their nominated courier. The Item was accordingly handed over to M/s TNT courier on 21.01.2008 (Docket no. DO 931 567 201). As per the courier receipt the item was delivered to their office on 22.01.2008.

Since there was no response I continued to follow up and received a phone call from their office on 18.02. seeking details of the consignment. I had sent many reminders over e-mail since then, but have not heard from them.

I had also complained to CORE, and they had also forwarded the complaint to AVA Merchandising on 07.05.2008. However there is no response. CORE is also not responding to my queries.

I feel this is a case of cheating, by an organisation which is spending a lot on advertisements, and something needs to be done so that more people are not cheated. Can you help me. I am willing to pay for expenses, even if it means paying more than the cost of the goods.
