Damage/broken of sole of shoe pair in two months

I purchased a pair of Black Shoe Bata FLEXOLOGY on 12.5.2010 from FD-7Pitampura, Delhi, store, against Cash Memo 12-05 10/1/0005 03375 dated 12.05.2010 indicating warranty upto 75 days from Date of Purchase. On 12.07. the sole of above shoe have damaged/broken and on 17.07.10, I visited the Bata Store at FD-7, Pitampura, Delhi and met with Store Manager alongwith damaged/broken sole of shoe and cash memo but he shown his inability to do anything as the store is being permanently closed and they are in process of winding up everything. However, he (store manager of Pitampura) told me to visit the Tilak Nagar Store for claim but it was objected when nearest store at AG-38 Shalimar Bagh, Delhi is available, why too far at Tilak Nagar, Delhi. On this, he (store manager of Pitampura) became annoyed and said if you want claim, you have to go only Tilak Nagar, Store. Anyhow, I requested him to atleast make phone call to Tilak Nagar Store Manager to entertain us for claim, which he did resentfully.

on 17.07.10, I visited Tilak Nagar Store with cash memo and damaged/broken sole of shoe, the Store Manager Sh. Chauhan lost his tamper and started shouting and misbehaving in front of every customer at the store. All customers present in store were surprised with the behaviour of Sh. Chauhan, Store Manager and some of them questioned him “how can you say no to claim in such a manner”. I feel very humiliated that I made a crime on purchase of Bata shoe.

The claim Policy which was displayed at store read as” we provide 100% replacement for major manufacturing defects, If the concerned product is brought our store within 60 days from the date of purchase”. The Definition for major manufacturing defects was also given which read as “ (i) Damage/Discoloured upper material (ii) Broken/damage sole or insole.

Sh. Chauhan Store Manager of Tilak Nagar Store has shouted as per Company Policy the claim for only 50% of cost is admissible and on Saturday and Sunday it will not be entertained. He was shown the Company Policy which was displayed at the store itself where 100% claim is admissible on major manufacturing defects of broken/damage of sole and on his other pretext, customers present in store have asked him to produce where it is written that on Saturday & Sunday no claim is entertained. On this, he shouted that I would not entertain this claim as the said purchase was not made from his store and anyone present in store can make a complaint to any authorities of Bata India Ltd.
