Fraudulent Use of Citibank Gold Credit Card No 5546 3795 0595 3008

Dear Sir,

I, Mr Vijay Kumar Mishra, held a Citibank Bank Gold Credit Card number 5546 3795 0595 3008 till 24 February. This credit card was valid from November through November.

1. My above said credit card was physically destroyed by me on 24 February and handed over to Mr. Sunil. This was done by me on the personal and specific advice of Mr Sunil, representing M/s Citibank on the assurance of issuing me with a fresh Platinum Citibank credit card. As a consequence, the duly filled application form for the issue of a Citibank Platinum card was done and handed over to Mr. Sunil on 24 Feb 09 at around 1400h. Copy of receipt for Application Form No. 2496717 is attached.

2. Between the 24 Feb 09 1400h till 26 Feb 09 upto 1200h and even thereafter, I did not use my Citibank Gold Credit Card No 5546 3795 0595 3008 as it physically did not exist with me.

3. On 26 Feb 09 around 1200h, I received a telephone call from the Citibank informing me that my Citibank Gold Credit Card No 5546 3795 0595 3008 had been used on 25 Feb 09 to make purchases totaling to an amount of Rs 1, 50, 375.00 (Rs One Lac Fifty Thousand Three Hundred Seventy Five Only) as per details as under, despite the fact that I had not used it nor did the said card physically exist.

4. On being informed on the telephone on 26 Feb 09 by the Citibank, I immediately conveyed to the Citibank Officer that I had used my said card on the evening of 21 Feb 09 and had not used the same card on any date there after. I, on being suggested by the Citibank Officer, authorized Citibank to block my Citibank Gold Credit Card No 5546 3795 0595 3008 with immediate effect. I understand that my instructions to the Citibank have been complied with.

5. Immediately there after, on 26 Feb 09 I reported the above misuse of my Citibank Gold Credit Card No 5546 3795 0595 3008 to the police Officer, Shri Jag Ram, Chowki In/Charge, Sector 14 Police Post, Gurgaon. The police Officer, Shri Jag Ram, Chowki In/Charge, Sector 14 Police Post, Gurgaon did not record my complaint on the grounds that this incident did not fall within the jurisdiction of his Police Post.

On 26 Feb 09, I then reported the matter in person to Ms Vineeta Malhotra, Service Relationship Manager, at the Citibank Office, Ground Floor, DLF Square, M Block, Jacaranda Marg, DLF City, Phase II, Gurgaon. Since Ms Vineeta Malhotra refused to accept my complaint in writing, I related my complaint and the misuse of my Citibank Gold Credit Card No 5546 3795 0595 3008 to her verbally. Ms Vineeta Malhotra, Service Relationship Manager, at the Citibank Office advised me not to approach any other person or agency in the said matter for one week as they, the Citibank, will conduct their own enquiry. On completion of any action at their end, Ms Vineeta Malhotra, Service Relationship Manager, at the Citibank Office informed me that the Citibank team will contact me and advise me further in the matter.

7. As a consequence, I approached Shri Rakesh Arya, Deputy Commissioner of Police, controlling Officer of Sector 14, Gurgaon on the telephone on 27 Feb 09. On instructions of DCP, Shri Rakesh Arya, the police Officer, Shri Jag Ram, Chowki In/Charge, Sector 14 Police Post, Gurgaon received my complaint in writing. Copy of the said report duly received by the police Officer, Shri Jag Ram, Chowki In/Charge, Sector 14 Police Post, Gurgaon is attached.

8. On 27 Feb 09 itself, I reported this case to the Additional Commissioner of Police, Economic Offences Wing (EOW), Crime Branch, Delhi Police, Qutab Institutional Area, New Delhi in writing. The case has been registered with them vide Registration No. D-950 dated 27 Feb 09. Copy of the said report duly received by the Office of the Additional Commissioner of Police, Economic Offences Wing (EOW), Crime Branch, Delhi Police, Qutab Institutional Area, New Delhi is attached.

9. On 27 Feb 09, I received a telephone call from Mr. Nishant and Mr. Ritesh of Citibank Fraud Department. On their advice I proceed to Police Station, Malviya Nagar, New Delhi. I handed over a copy of my complaint to the PS in charge and also to Mr. Sushil (Cell No. 9213606298), a representative of the Citibank who at that time was helping the Malviya Nagar Police in their investigations in similar fraud cases and where apparently an identification parade was in progress.

10. On, once again, approaching Shri Rakesh Arya, Deputy Commissioner of Police, controlling Officer of Sector 14, Gurgaon on 28 Feb 09, and on his instructions once again, my above said complaint was included in the Police Daily Diary (DD) by the police Officer, Shri Jag Ram, Chowki In/Charge, Sector 14 Police Post, Gurgaon on 01 March 09 and a copy of the same is hereby attached.

11. On 02 March 09, I sent to Commissioner of Police, HQ, IP Estate, New Delhi a copy of the Police DD dated 01 March 09 along with other related documents.

12. On 03 March 09, I sent to Commissioner of Police, Gurgaon a copy of the Police DD dated 01 March 09 along with other related documents. These documents were sent by Speed Post dispatch reference No. SPEH086689995IN dated 03 March 09 Gurgaon.

13. On 03 March 09, I also sent an e-mail to [email protected] and also to [email protected]. Copy enclosed. Citibank reference number given to me for registering this complaint is ‘009-352-458’.

14. Sir, 21 days have elapsed since this case of fraudulent misuse of my Citibank Gold Credit Card No 5546 3795 0595 3008 took place. I have left no stone unturned in the matter. I am understandably undergoing severe mental trauma and agony. However, the Citibank has not yet reverted back to me at all.

15. Sir, I request that your Honor may kindly pass suitable orders, amongst others as under

a. I be not held liable to any misuse of the above mentioned card after 1355h on 24 February

b. The card company must indemnify me against any other consequent liability

c. The card company or any of its assigns refrain from any coercion or pressure tactics on me in respect of the disputed transactions as above

d. Pass any other suitable orders as felt appropriate
