I have entered into an agreement to purchase a flat in Mumbai and in this respect I have paid him Rs.21000 cash as token amount for such sale to the owner.
In respect of the above transaction, The owner introduced me to the secretary of the society and asked me to pay Share Transfer fee and Property tax arrears to get the NOC from society. On his request I have paid to the Society Rs.25000 as share transfer fee and Rs.14203 as arrear of property tax through my a/c payee cheque. Kindly note that the secretary of the society accepted the cheque without any document and handed over the receipt for the same to me.
After paying the above-said amount, The owner refused to complete the sale proceedings and to get the NOC from the Society hence, I requested to the society through latter with mentioning all the fact and requested not to issue any NOC to The owner to make able him to sell the flat. After receiving my latter the secretary of the society committed me that he will not issue any NOC without my consent.
After that in reply of my legal notice to The owner I came to know that The owner had already sold his flat. The sale of flat could only take place only after NOC issued by the society hence, I requested to the society to pay back the above said amount to me but the society is not ready to pay back me the above share transfer fee and property tax arrears.
In view of the above, it is being requested to you kindly suggest (with address) me that what action I can take against the society and where I can make complain for the same.
