Dear Sir / Madam,

b) Fixed Deposit Receipt No. FD 183887, Dated 14.12.2000

c) Account No. FD 183887

f) Date of Maturity – 13.12.2001.

Re. : Full & Final Settlement

It has bring to your kind notice that aforesaid Fixed Deposit (Xerox copy enclosed herewith for your ready reference) already been matured on above referred date and subsequently deposited to your good office on 23.11.2001 for redemption purpose (Xerox copy of the acknowledgement is enclosed).

In response to the above acknowledgement, M/s. CB Management Services Pvt. Ltd., Kolkata (The said co. acted as an Investor Services Division on behalf of Duncan Industries Ltd.) had forwarded me a letter being No. DILFD/REF/FD183887, Dated 17.01.2002 (copy enclosed) alongwith a post dated cheque being No. 432206, Dated 30.04.2002 which was drawn on State Bank of India, Commercial Branch, Kolkata : 700 016 for the principal amount of Rs.13, 000.00 (copy enclosed) and a interest cheque only for the delay period calculated from the date of maturity to till the date of the cheque, which comprising with the aforesaid letter issued by CB Management Services Pvt. Ltd., Kolkata.

The undersigned had placed the said cheque to his bank for encashment but unfortunately the cheque was dishonored by the drawer’s bank due to a reason of ‘ Payment stopped by the drawer ‘ (copy of the returned memo enclosed). But thanks to Duncan Industries Ltd. For honored the aforesaid delayed period interest cheque.

After that on 09.05.2002 the incident mentioned in the above paragraph brought to your notice and also brought to your Investor Services Division’s notice (copy of acknowledgement by DIL enclosed) and seeked to release the above fund.

Meantime you (DIL) had forwarded me a letter having Ref. No. DIL/FD/FD815491, Dated 07.03.2007 alongwith a FDR having No. FD183887 for the period of one year without my prior approval / consent (copy of the letter issued by you enclosed). But there was a scope allowed by you as per the above letter that investor might be surrendered the new FDR through a covering letter. The undersigned had opted the scope of surrendered the new FDR vide his letter dated 06.05.2002 which was acknowledged by DIL on same date (copy enclosed) and once again cordially requested to release his dues but the situation remains no stone unturned.

In response to my letter dated 09.05.2002 as mentioned above, now your Investor Services Division had informed me vide their letter No. DIL/MSCRC, Dated 11.05.2002 (copy enclosed) that DIL have approached to the Company Law Board for repayment schedule of outstanding deposit and you had assured me that they would intimated me in due course once they got the same from the Company Law Board.

After that you (DIL) have forwarded me the repayment schedule of Fixed Deposit determined by the Company Law Board vide your letter Reference No. DIL/FD/30538, Dated 15.07.2002 (Copy enclosed which is self explanatory).

After getting the above letter regarding repayment schedule determined by the Hon’ble Company Law Board, Eastern Regional Bench, Kolkata (CLB) the investor simply waited for 2 years to notice the development of the scheme. But the situation remains same. Then the undersigned had lodged an appeal vide his letter dated 26.06.2004 to ‘ The Manager – Public Deposits, Duncan Industries Ltd. “ to clear the undersigned’s entire dues which was acknowledged by DIL on 28.06.2004 (copy enclosed), subsequently he had placed the same letter before ‘ The Bench Officer, Company Law Board ‘ which was also acknowledged by 28.06.2004 (copy enclosed) and placed the same to ‘ The Manager – Investor Services, CB management Services Pvt. Ltd. ‘ which was acknowledged by them on 29.06.2004 (copy enclosed).

Thereafter, I’d sent some reminders vide my letter dated 04.08.2004 against the above to ‘ The Manager – Public Deposits, Duncan Industries Ltd. ‘ which was acknowledged by you on 05.08.2004 (copy enclosed), The Manager – Investor Services, CB Management Services Pvt. Ltd. which was acknowledged by them on 06.08.2004 (copy enclosed) and to ‘ The Bench Officer, Company Law Board, Eastern Region Bench which was acknowledged by them on 05.08.2004 (copy enclosed).

At last the situation had changed his way quiet a little i.e. the undersigned got a cheque being No. 617892, Dated 15.12.2004 drawn on HDFC Bank Ltd. of Rs.650.00 (Counterfoil of the cheque enclosed herewith which is self explanatory).

Entire situation has bring to your notice, though the letter become too much lengthy due to your lack of importance to the matter. Still I’ve convey my thanks to you for go through the letter patiencefully.

Now, once again the investor humbly requesting your kind goodself to release the capital amount of Rs.12, 350.00 (Amount deposited Rs.13, 000.00 – Cheque received from DIL Rs.650.00) and accrued interest @ 14% (as mutually agreed upon us comprising with the attached FDR) til date. Please be noted so far DIL hasn’t release any interest (except delayed period interest as mentioned above) against the investment.
