Subject: Dishonesty and fraud committed by M/S M G R automobiles Pvt Ltd., Heritage Honda, Agra, U.P. in delivering a vehicle

I am a senior Associate Professor and practicing physician at J.N. Medical College, Aligarh Muslim University Aligarh. It is to inform you about the gruesome dishonesty, which prevails at Heritage Honda, Agra, U.P. I have to submit the following facts for your kind perusal and necessary action:-

That I wished to purchase a Honda City model ZX-GXI for which I contacted number of dealers from Agra, Mathura, Delhi, Gaziabad and other nearby places. The dealer’s agent (Mr. N.S. Chauhan) from Heritage Honda, Agra was quite active and vibrant in handling the deal and personally visited at my residence in Aligarh about a fortnight ago and also took me to ICICI bank for car loan. He convinced me to offer to give the discount of about Rs. 30, 000/- 40, 000/- and even I was more than convinced, when Mr. N.S. Chauhan from Heritage Honda talked about the repute of Honda and later he offered the same discount which I was trying to negotiate with other dealers in proximity that was about Rs 40, 000/- (Rs 20, 000/- over and above the U P registration fee).

That I personally know the repute and prestige associated with the Honda Automobiles as 3 members from our family are already the pride owners of Honda city. I selected Heritage Honda as it was closest to Aligarh, thinking about the service benefits though the discount offered was less than what otherwise I was being offered from other places. A week back I received a call from Mr N S Chauhan who enquired about the choice of the colour of the car and persuaded me to take delivery even at Aligarh, to which I refuted saying that “I will take the delivery from the showroom itself.”

That It was on 4th June, N.S. Chauhan from Heritage Honda called me to visit his showroom for selecting the Vehicle of my choice. Finally I decided to move with family and friends at Agra for selection and collection of my car on 5th June. It was really shocking and surprising for me to see that only two vehicle of make ZX-GXI were present in the showroom, out of which one with make ZX-GXI colour grey was booked to some other person. The second car of make ZX-GXI colour white, was there, which was told to me that it is “your’s car” and “is ready for delivery”. It was really disgusting to see their adamant attitude of keeping a vehicle even ready before choosing and selecting. “Is this a reasonable attitude of any dealer to impose a car, when I am visiting with my family and friends for the first time at Agra, about 86 km from Aligarh”?

That Secondly the height of dishonesty and mistrust, which they created at the time of delivery, is something which rakes the name and fame of a company of such repute. I was least satisfied with their way of functioning and imposing vehicle on the client without test drive, choosing and selecting.

Thirdly the dealer was trying to hasten the process of delivery. They prepared all necessary documents without showing me and placed before me for signature and its receipt. It was all of a sudden I found that the service book had my particulars written after erasing some other customer’s particulars. Subsequently I refused to receive the car saying that “I cannot be the second owner of this car, as some other’s car is being delivered to me” over which they callously answered that it is just a clerical mistake. Further they argued that the service book got changed with another white car which has to be delivered today to some other customer. After having heated discussion they showed me the particular of M/s Sunita Dhawan, r/o of Kamla Nagar, Agra whose name was entered over it. It is pertinent to note here that M/s Sunita Dhawan’s car has already been delivered on 3/6. How it got changed on this date (5/6)? Truth is that M/s Sunita Dhawan had refused to accept this car, as it had scratch marks and dents which were later repaired with local spray paints. They deliberately planted my name to befool me. The service book clearly shows that they tried to plant my name over Sunita Dhawan and all the details regarding Engine no., Chasis no. remained unaltered. The biggest blunder which could not be rectified was the “erroneous battery number” in the service book. Their haste was to such an extent that my residential address was wrongly entered at different places. I am attaching a copy for your perusal.

That fourthly they tried even to alter the “warranty registration card” bearing booklet no. K103455 which was in the name of M/S Sunita Dhawan, resident of Kamla Nagar, Agra (to be submitted by dealer to the company).

That finally after witnessing a height of dishonesty and fraud at Honda showroom, I refused to collect the vehicle. I insisted on a new car, which I planned to collect on 6th June, but they were quite adamant and started pressurizing me to take the delivery as papers were ready in my name and the car has been registered under my name. They further argued that “nothing can be done now as the car has been registered under your name.” I was neither provided the invoice nor the temporary registration. Regarding temporary registration they gave me the arguments that “it has been filed before RTO office Agra for temporary registration and the same has not been signed till date (5/6/08). It is pertinent to note here that the said registration was filed before RTO office only on 6/6/08. I reached Aligarh with a heavy heart and lots of hatred for the dealer and company.

That I could not imagine that a company of such repute could ignore the element of customer satisfaction. Mr. N.S. Chauhan assured me to offer a discount of about Rs. 30, 000/- to 40, 000/-, where again I was befooled, as I was given only discount in the form of (Corporate discount = Rs.10, 000/- Extended warranty = Rs. 7, 500/-) plus a body cover, matting and mud flap. Do you think, this is right on the dealer’s part to commit something and offer almost nothing at the time of delivery?

That it was more of imposition rather than purchase with greater satisfaction. I never suspected that dealer of a company of International repute can adopt such a ruffian attitude towards the customers. They collected the complete payment (Rs. 43, 900/- vide receipt no. 14822 dated 5.6.2008 (ii) receipt of 7 lakh DD in favour of the dealer vide receipt No. 11192 dated 5.6.2008 issued by Union Bank of India, Aligarh) and asked me to collect the vehicle otherwise face the dire consequences. I felt cheated I repeatedly persuaded them to change the vehicle, as till date neither the invoice nor the registration process has been completed. It was their deliberate attempt to get that rejected vehicle registered in my name.

Is it possible for a dealer to deliver the vehicle without even filing the temporary registration papers at RTO office? In this exceptional case, this deviant practice to impose the rejected vehicle in my name, it has been glaringly done in front of my eyes?

That later on 6/6/08 I personally reached RTO office to enquire and verify about its registration. To my utter surprise it was found that it was not filed even before 12 noon. Subsequently I rushed once again to the Honda Showroom and requested for its change as the same has not registered in my till now, and also showed the scratch marks and the dents to Mr. Chauhan as well to General Manager Mr. Anil Mall who also accepted the same but said that “nothing can be done as the car has been delivered to you”. They even called their painter/denter who also verified the same and said that it will take 3-4 hours for its repair. How can a dealer of a company of international repute can dare to do this?

That all my request were turned down and I returned to Aligarh after 7 PM on 6/6/08 without temporary registration and invoice. Once again I visited showroom on 7/6/08 with the same request but my request fell on deaf ears and it was today (7/6/08) I was provided a copy of the registration at 7 PM.

That now, I request you to look into this matter seriously as these goons/ruffians are managing the showroom. Secondly without selecting and choosing how a vehicle can be made ready without one’s consent. Thirdly refusing to acknowledge the receipt of vehicle will lead to dire consequences. What it means? Fourthly asking me to leave for Aligarh on 5th June without temporary registration, when I was made to pay Rs.1050/- on behalf of temporary registration. Fifthly, the culmination of mistrust at the time of delivery. Mr. N.S. Chauhan assured me to offer sizeable discount, and later on denied for everything. Lastly the tempered/altered records in the service book.

Can Honda bear all this nuisance of a dealer at the cost of customer satisfaction, that too when I am associated with such a premier Institution and member of almost 7 National and 5 International bodies. I paid in full for the vehicle, whereas, I could neither get the better deal nor the vehicle of my choice as a first owner. It was really a painful experience for me. I suffered from mental agony, pain and anguish. I visited their showroom thrice consecutively, but those goons turned their deaf ears. I was really frustrated to see the reckless behaviour of a Honda dealer, who was least concerned about the client’s satisfaction and needs. It is again requested to get “my car inspected from company’s regional Engineer to verify the above said facts and figures.” I hope a company of international repute would immediately take necessary action to cancel the dealership of M/S M G R automobiles Pvt Ltd., Heritage Honda, Agra and I may be given an opportunity to select and choose a new car of my choice in lieu of imposing a damaged and repaired vehicle and that too with second ownership.
