Dear Sir,

I am complaining about the company for not refunding my Provident Fund. This is with regards from last 10 years the afore mentioned company is not intrested in the refund of my Provident Fund. After giving them several reminders with the same subject matter.

Herewith attaching the details required to know about the company communication.

Subject: - Regarding the Provident Fund and the Full and Final Settlement not received.

Dear Sir,

I Prashant P Pimpale joined Indchemie on 2nd May 1998 (Emp. Code – 03121) and Worked at Latur Headquarter as per the standard terms and conditions mentioned in the appointment letter. I received the confirmation on 1st April 1999 the letter regarding the confirmation which I received was subject to Mumbai Jurisdiction.

I was forced to resign from the post of medical representative in the month of June by Mr. Sanjay Baneerjee. He was the Zonal Sales Manager for the West region. After resigning I haven’t received any of the settlement that was with the company to be paid. This included the expenses and Salary for the months of May and June. After resigning Mr. Baneerjee conveyed that the dues pending will be paid in my final settlement.

After continuously asking the status of my settlement there was no one who was able to tell me the correct information. Now it is more than 9 years and I Have not received any correspondence from the company. Since then I have spent more than Rs 10000/- on the telephone, journey to Mumbai HO and correspondence.

On 7th September I went to Mumbai HO after the teleconic discussion with Mr. Shukla, where I discussed the whole matter with him. He assured me to settle down my accounts at the earliest. I gave the photocopy of all the documents including the Bank account details, address for correspondence and Identity Proof. On his assurances I kept on calling him for the status quo of my subject matter. After conveying him that I am going to pass on the matter to the Labour Court on the company’s behalf he gave me the call and conveyed that there are certain pending dues that needs to be cleared. I was shocked to hear this, after 9 years the company is asking the money from me instead of settlement.

I asked for the further information pertaining to the pending dues, he gave me some figures that the stockiest have sent in written to the company. After knowing this story I came to the conclusion that company and the authorities are not interested in settling my account.

Dear Sir, my question is that when it was the company’s money or the money where the company’s interest was lying there was not a single individual who can contact once to me regarding this matter. Not even the company felt this in the long span of 9 years. There was no correspondence from the company while I have the letters that I sent through the Registered AD to the company regarding the settlement and for the non cooperation from the organization. From time to time I have asked for my PF account no and the receipt for the same.

If the company is not interested in settling the accounts pertaining to me. There is no other option available other than the Labour Court.

After the discussion I have nothing to pay to the stockiest and if they are posing that I have to pay to them they and the company need to provide the proofs for the same. This issue is rotten now and I have smelt it a lot now it is the time to share this.

For your perusal I am sending the photocopies of the appointment and confirmation letter to you along with the achievements in the form of recognitions and recommendations that I have gained in the company when I was in the services of the company at the same HQ.

I am fed up for the company’s step behavioral attitude towards me. If someone with some sense for his duties respond to the letter at the earliest.

Communication II

To,

Date – 10th January.

Subject – Reply to your letter dated November 4th.

Dear Sir,

As per afore mentioned letter stating about the settlement for my accounts.

As per mentioned in my previous letter dated 27th October. Thanks for having courtesy to reply for my letter. Certainly whereas you’ve stated in all you Letters Marked as “A, B, C, D, E, F, G, H”, starting it as Final Reminder for the settlement.

That wasn’t enough without any documented evidence you’ve mentioned in your Letter “A” at the bottom that,

1. You are requested to intimate us the following details about the aforesaid person within 15 days of the letter, which will enable us to settle his account.

2. Payment received by him directly, either in cash or by cheques from any stockiest or distributors on our behalf.

The above mentioned sentences were quoted for me to the reference of the Regional Head and C & F/Depot Head. Certainly this might carry certain probable proofs of either accepting money by me in cheques from distributors, please ask the distributors to present the cheque details which I have accepted on behalf of the company or the vouchers of the cash accepted by again on behalf of the company.

As per your letter dated July 16th (Ref – HO/PER/S-767) Marked as “C” stated that you will initiate the legal proceedings against me and also inform the present facts to my present employer. The same linguistic behavior is stated and mentioned in all your further correspondence Marked as D, E, F, G, and H. Adding to this still in the span of 10 years if my offence was the severe one why the company was so impotent to initiate legal action against me?

As per you correspondence (true copies send to me thro’ Reg. AD) you have wrote the letters but I was unfortunate to not to receive them at my End. Certainly not a single letter was received to me. Further can you send me the Acknowledgement true copies for the afore letters, as such you’ve taken pains of sending me the true copies.

As per your communication will you please send me the bills (Carbon Copies and Not Xeroxed) of Om Traders Nilanga Rs 4, 364/-.

In all your letters you’ve mentioned about the settlement that doesn’t includes the Provident Fund.

I spoke with Mr. Shukla regarding the status of my provident fund and the settlement. I conveyed Mr. Shukla about the proceedings that I have forwarded the case in the Labour court due to non cooperation from the company. After asking him about the Provident Fund and settlement, is company having any rights to keep hold of the employees Provident Fund? If such is the case then under which clause this is included. Because after handing over the bank details for more than thrice still I am in non receipt of the Provident Fund.

He said that I can do nothing to the company by putting the case. I very politely asked about the distributors bills that they have asked in their letters to be paid by me. Mr. Shukla added that all the proofs in original will be submitted in the court by the respective distributors.

From henceforth Mr. M. K Singh (CEO) is the responsible person to look after my settlements.

This was the last teleconic communication that I had with Mr. Shukla.

Communication III

Subject – 1. Reminder for the previous communication dated 10 January.

2. Reminder for the Provident Fund withdrawal.

Dear Sir,

I have not received any reply from your end, for my communication with regards of my settlement and Provident Fund. This is subject to the letter dated 10 January.

Two months are sufficient to reply for the communication that I had with you through Registered AD. As per the last letter, dated 10 January I have the POD (acknowledgement) for the same. Would further like to clarify certain facts based on the present scenario.

As per the last communication I am in receipt of your reply that under which CLAUSE the company is having the rights to detain the Provident Fund of an Ex Employee for more than 10 years.

In the need of medical emergencies, is there right for any organization to keep hold of the Employee Provident Fund amount?

Few days prior I was diagnosed with hypertension and certain fat tumors were detected in the various parts of my body. This is to bring your notice that today I am unemployed and non working. In this scene I am not in the condition to afford the medical expenses that are need to be incurred.

Medical reports that will be presented with prescriptions will be from an MD PHY.

This is not to gain any sympathy from your end; this is to bring the facts to your notice.

In such circumstances I need my Provident Fund amount, which is with you from last 10 years.

This issue is now rotten enough to be handled from one end, because I have to wait for your reply and communication for months with regards of my Provident Fund.

Due to your disparity, I am not able to understand your stance with my subject matter. As per your first and last communication (since then I haven’t received any), I am ready to face the consequences on my cost as already I am bearing them.

Or is it the fact that for the purpose of replying you are replying my communication after months and years without any intention for resolving the problems.
