Employer not paying the fix salary for Telemarketing Guys

Hello,

One of my friend is working with Telemarketing Company as a telesales. As per their company rules they have been not paying any fix wages or salary for the month, they will get paid commission if they sale their product. Also they have not given any offer letter or appointment letter, but yes they are signing their attendance muster regularly.

I would like to know:

1) Is it legal to appoint an employee without salary?

2) What are the provisions and act if above case is legal?

3) What action we can take if employer not pay even commission or exploit at work place.

It would be appreciate if you answer my above queries as soon as possible.
