Complaint of House Tax, M.C.D. Delhi

Dear Sir

This Complaint is Against the MUNICIPAL CORPORATION OF DELHI & the complainants are Mr. ASHOK KUMAR, MR. KISHAN KUMAR, and MR. RAJ KUMAR all R/o 2/76 Roop Nagar, Delhi-110007 who equally & Jointly owns Property No 43, Commercial Complex, East of Kailash, New Delhi-110049. We purchased this property on lease basis from DDA in 1972 & constructed in March 1976.

We were paying House tax on the Ratable Value of Rs. 16800/-till the year 31st March 1988. We filed the case in lower court against MCD to reduce the ratable value on the basis of cost of construction. On 12th May 1988 Lower court fixed the ratable Value as Rs. 11810/- & ordered the MCD to implement the same. MCD filed appeal in the High court against the decision of lower court & started charging the house tax on the basis of Rs. 11810/-

We were regularly paying the house tax, but suddenly on 23rd March 1991 MCD issued notice to all the three parties for the payment of house tax raising the ratable value as Rs. 656640/- instead of Rs. 11810/- along with the previous dues of Rs. 1648737/= which was calculated on the Ratable value of Rs 656640/-without assigning any reason. That was not justified as the case was still pending in High Court on that date. Now this amount has gone to more than Rs. 60Lakh including interest & penalty for no reason at our end.

The reason for sudden hike is unknown till this date in spite of our several letters and objections in ratable value. We sent several letters to MCD to reconsider the ratable value but all in vein. In spite to this MCD sent the demand notice of house tax on regular basis irrespective of the case pending in the High Court. On 10th March the Honorable High court ordered MCD to consider the ratable value as per the lower court order on the basis of BALBIR SINGH (SUPRA) VS MCD, but MCD did not consider the High court order & in spite of our several letters in this reference and visits to officials of the department i.e. Assessor & Collector Sh. Brij Lal, M/s Sangeeta Kamplani & several others.

Every time we visited MCD office, we were harassed by the officials as they did not pursued the case in any sense and sent the demand notice on the basis of ratable value of Rs. 656640/- the ignored the honorable High court order.

This is nothing but harassment by MCD to parties & contempt of High Court decision.

We hopes from you, Sir please pursue the case & enable us to clear our entire dues on the actual ratable value which has been decided by Honorable court & honorable High court i.e. Rs. 11810/-
