Brief of the case on non payment of F.Ds and interests:
1.Upon my retirement from one of the P.S.Us, I invested a part of my P.F and Gratuity money in Fixed Deposits (4 nos) with M/s Duncan Industries Limited, at 31, Netaji Subhas Road, Kolkata-01 – two of FDs were in my name and other two in my wife’s (Smt. Manjusha Biswas) name. The B/U of the investments are as under:-
1). Ajit Kr Biswas FD Nos.(a) 162723 of Rs 34, 000 matured on14/07/03 ;(b) 370272 of Rs16, 000/ matured on 04/11/03
2). Manjush Biswas FD Nos.162722 of Rs 34, 000/matured on 14/07/03 " (b) 370273 of Rs 16, 000/ matured on 04/11/03
2.By a Notice No. DIL/FD/12049, dt 21/03/02, the said Company advised us that all the unused post-dated interest warrants were to be surrendered to them on or after 23/04/02 “to restructure our Banking Accounts”. (The advised complied with by the depositors). Since then the subsequent interest warrants were issued month-wise.
3. In the mean time, the said Company went to Company Law Board. The CLB published in newspaper informing the Depositors about the change of payment schedules but advised that those Depositors who needed special considerations against Hardships on medical, ill health etc could apply for Special Consideration. In response to this, I submitted an application to CLB wherein high-lighted my claim for specials treatment on Medical Ground since undergone By-pass, Angioplasty, Cholecystectomy, Stroke etc. To establish the claim, I submitted all the relevant documents along with the application. Accordingly and against that, my case was considered vide Serial No.105 T02; 108 of CLB’s List no.2.
4.By a notice No. DIL/FD/24001 Dt 15/07/02, the said company informed the change of Schedule of the payments which had been mentioned by CLB (in News-paper dt.21/06/02)
5.By another Notice No. DIL/FD/23071 Dt. 15/12/03, the Company informed that payment of principal would be repaid in four installments from 5 to 9 and interests from 5 onwards.
6. In last July, Iundergone another operation which became serious due to my ill health and heart ailment. 7. My repeated appeals to the Company to release the pending interest and principal amount of the F.Ds. were not heeded even though I had mentioned to them about my ill health, and that I am a Sr. Citizen deserved humanitarian consideration. Besides these CLC order to the same was also reminded to them.
8.In last Sept '08, I was diagnosed to be suffering from Ratinal degeneration. If not immediately attended to, I will go blind. The estimated expenditure is around Rs.1.5 Lakhs.
