I am Mathews M Mathew, S/o M E Mathew (Late), residing at Mathurampoikayil House, Thekkumuri, Kallepulli P O, Palakkad.

In connection with the treatment of my aged mother Mrs Mariyamma Mathew I faced a Medical Negligence from Dr Shibu Mathew, Ortho Surgeon of Paalana Institute of Medical Sciences, Palakkad and Service Negligence of Paalana Institute of Medical Sciences which caused to the death of my mother on 19th January.

I have already sent registered letter to the hospital authorities explaining my grievances on 7th February for suitable compensation. In addition to that another letter had been given on 7th February for providing the treatment history of my mother.

They have not replied to me for both the letters till date.

Therefore I need an advise what to do further.

Sub: Death Due to Medical Negligence by Ortho Surgeon, from Paalana Institute of Medical Sciences.

My mother Mrs. Mariyamma Mathew, 82 years, fell in the bathroom and had been admitted in your hospital on 8th December for treatment due to fracture on her left thigh. She was moved to ICU immediately after taking X-ray. Dr Shibu Mathew was the Ortho Surgeon and informed us she required an urgent operation. A surgery was carried out on 10-12 by Dr. Shibu Mathew and he told that a steel rod has been inserted in the bone. Next day she was moved to pay ward, Room No 216. At that time we noticed that she had developed Bed Sore. When we enquired about the condition of my mother after the operation he was not ready to explain the situation. We also asked about the bed sore my mother got developed. His reply was that it is common and they are not responsible for such things happening during treatment. But she did not have any bedsore at the time of admission in the hospital.

On 14th December my mother developed breathing trouble and she was shifted to Medical ICU. We were waiting eagerly in the side room till 8 pm to know about her situation. But the surgeon left the ICU without saying anything to us.

On 15th December she was again shifted back to Room No 216. The condition was the same with breathing trouble. We came to know that it was due to infection in the lungs.

On 22nd December Dr. Shibu Mathew discharged the patient saying that the wound was healed and to come back for review on 29-12. But she had colourless discharge from the wound. When we enquired about the Doctor we came to know that he went to his native place to participate Christmas celebrations.

On review date I brought my mother to hospital in Ambulance of Paalana Institute of Medical Sciences and met Dr. Shibu Mathew in the OP. As per his opinion once again X-ray was taken. Repeated requests were made by us to consider the problem of oozing from the wound. But he told the staff to send the patient home after dressing the wound. We told him that it may be due to infection of the wound but he replied that he has taken care of everything. We brought my mother back home after review by Dr. Shibu Mathew and that time also she had breathing trouble and had pain in her neck. But the Surgeon told that it is normal and will be OK after taking the medicines prescribed.

When we asked the surgeon about the food to be given to my mother during her treatment in pay ward there was no clear instructions.

By 3rd January her condition was very bad and became restless, breathing was difficult and the patient was not in a condition to move to Paalana Institute of Medical Sciences which is far from our home. We contacted Dr. Samuel Varkey, Retd Surgeon of District Hospital, Palakkad, for his opinion. Dr. Samuel Varkey visited the patient at my house. We explained all details about the treatment done till date to Dr Samuel Varkey. On advice of Dr Samuel Varkey we contacted Dr. Sunil Sridhar, Ortho Surgeon at Malabar Hospital, Palakkad. My mother was admitted there on 4th January as directed by Dr. Sunil Sridhar. They diagnosed that she had developed Septicemia from the infected steel rod used for nailing inside the femur and it was already spread throughout the body through the blood and affected her lungs, kidney, heart and brain. His opinion was that it happened only from operation theatre, and the condition was very critical as the infection was from inside the bone. My mother was put on ventilator and treated with antibiotics. On 11th January the patient was sent to KG Hospital, Coimbatore, on his advice for higher treatment.

She died on 19th January due to the basic reason of Septicemia from the infected steel rod used by Dr. Shibu Mathew for surgery and the poor service of Paalana Institute of Medical Sciences.

We would like to bring before you that the nursing staff who attended my mother were inexperienced. They were conducting experiments on my mother as most of them were students. The bedsore developed while she was in the ICU itself proves the poor nursing even in the ICU.

My innocent mother suffered severe pain and respiratory problems in her old age for about 40 days after the surgery due to the medical negligence of Paalana Institute of Medical Sciences and improper nursing care. The surgeon neglected the feed back and requests from the relatives of the patient regarding the dangerous development of patient’s condition. He insulted and abused me several times when I tried to discuss the matters with him and he was very cruel to the patient.

We spent more than Rs.5 lakhs for treatment of my mother due to the septicemia infected from Paalana Institute of Medical Sciences and medical negligence.

Moreover all our family members suffered both physically and mentally due to the cruel attitude of Paalana Institute of Medical Sciences. And finally we lost our beloved mother. The service rendered to the patient by the medical staff of Paalana Institute of Medical Sciences was also very poor.

We believe that my mother lost her life due to the medical negligence of Paalana Institute of Medical Sciences as reasons mentioned above.

I believe strongly with the supporting evidence that the operation/treatment was carried out on haste and in most negligent manner resulting infection, bed sore and other complications.

The surgeon had failed to show fair, reasonable and complete degree of skill while performing the operation/treatment.

We have paid Rs 50, 922/- (Rupees fifty thousand nine hundred twenty two only) for all the charges for treatment.

Therefore I request you to suitably compensate for the life of my mother and for a reply within 15 days of this letter. Failure to do this we will be forced to take legal action.

My mother Mrs. Mariyamma Mathew, 82 years, fell in the bathroom and had been admitted in your hospital on 8th December for treatment due to fracture on her left thigh. After surgery she was discharged on 22-12.

We have paid Rs 50922.57 for the treatment in your hospital. But we have not received any treatment history/or records till date.

Therefore I request you to be kind enough to release the treatment history and other records from the date of admission to the date of discharge immediately for our future reference.
