Respected Sir,
I am Manjunath, aged about 35 year having parmanent residence at Dodda Aluvara Village, Thorenoor Post, Somwarpet Taluk, Kodagu District-571232, Karnataka.
I Have filed a petition under Section 12 (1) (c) of the THE HINDU MARRIAGE ACT 1955 IN THE COURT OF THE SENIOR CIVIL JUDGE AT MADIKERI VIDE M.C.NO.74/10 represented by Advaocate Sri. M.E.Mohankumarin prays to pass an order for decree of nullity and annulment of marriage solemnized on 08.05.2008 at temple, Konanur and on 09.05.2008 before the Sub-Registrar at Arkalgudu of Hassan District due to kidnapped on 07.05.2008 and obtain my concent by force with rowdy elements by the respondent M.B.Shantha @ Shanthamma, D/o Borraiah, having permanent residence at Mallapura Village, Lakkur Post, Ramanathapura Hobli, Arkalgudu Taluk, Hassan District presnetly residing with his brother Mr. Vijayakumar & Family at Room No.6/12, Raj Gopal Building, 13'C' Croos, Near Om Shakti Temple, Kaggadasapura, C.V.Ramannagar Post, Bangalore-560093 and her parents & brothers.
Hon. Court of the Senior Civil Judge at Madiker passed an order and issued notice to the respondent on 09.11.2010. After reciveing and knowing the fact of notice the respondent M.B.Shantha came to my residence at Dodda Aluvara village with rowdy elements & her brothers i.e. Mr. Gopala, Mr. Dayananda, Mr. Vijayakumar, Mr. Eswara and her Parents i.e. mother Mrs. Nagarathnamma (Laksmamma) & Mr. Boraiah and her Mama Mr. Laxmana and they did galata with my mother & mother when i was not there in the station.
Upon their visit and galata the same day night at 8pm my father submitted a police complaint with Hebbale Police Station, situiated in Kushalanagar range & Hobli, Kodagu District where my village will cover under along with the copy of the court petition. But the Policemen at Hebbale Police station did not registered the complaint, instead the policemen informed to my father that he may call at any movement to the policement if galata is continued. After got the assurance from the policemen my father came back to my home and at the time when my father reaches home they (respondent & allieas) were went off after knowing about police complaint made against them.
But again two days after respondent with her parents and rowdy elements submitted a police complaint against me & my family member at Kushalanagar Police Station mentioning that "Mr. Manjunath & his family members were cheated me"
Upon calling by the policemen from the Kushalanagar Police Station my father attended and again he has submitted a copy of the court petition with the Kushalanagar Police Station and prays them to give security as the case is in the court perview.
But Respected Sub Inspector of Police and the Respected Dy. Superintendent of Police, Kushalanagar refused request made by my father even though we have submitted the copy of the petition M.C.NO.74/10 issued by the Hon. Court and my lawyer Mr. Mohankumar spoke to & explained them as he it is the court perview and he is handling the case over telephone from Madikeri where he is having his office, they have started harassment to my father and mother and the same is being continued till today
Against this harassement my lawyer Mr. Mohankumar submitted a complaint to The Respected Superintendent of Police, District Police Office, Madiker-571201 on 29.11.2010.
But again yesterday Mr. Gopala (Brother of respondent & Team who kidnapped me from Bangalore on 07.05.2008) & team kidnapped my mama (who was helping to my family in day to day activities) and they have threatened him on the way to his house from Kushalanagar to Bettadapura, place situiated in Mysore District, Piriyapatna Taluk thye took him to Mallapura village and they tried to collect the evidence copies from him.
When my father went to Kushalanagar Police Station in the morning today on 23.12.2010 to report about kidnap made by the respondent's brother and team again Resp. Sub Inspector of police & Dy. Superintendent of Police, Kushalanagr harassed like any thing.
Hence I requesting in you to look into this and arrange to stop harassing my old age father & mother & my family members and arrange give the security till this case complited and result comes from the hon.court of law by giving instruction to the concerned.
