I atul whatkar struck a deal for a flat in thane brahmand ph III on a flat no. B-6 G-003 owned by mr NITIN SHETTY.general power of attorney for the said flat is in the name of mr NIRAV MATALIYA. i entered into an agreement with NIRAV MATALIYA on 09 Jan 10 which said that i pay 7 lacs out of 15 lacs by cheque to him & remaining 8 lacs will be taken on loan from HDFC HOME LOAN OFFICE VIKAS COMPLEX THANE & then be paid to the owner NITIN SHETTY.now mr NIRAV MATALIYA. obtained NOC from HDFC HOME LOAN OFFICE GOKHALE ROAD THANE .after i paid him the 7 lacs (he repaid his loan on the said flat).again in turn when this NOC was submittted to society they gave the noc to me saying that the said flat was free from all the encumberences liabilities etc.also they stated that they do not have any objection for sale of the said flat to me.now i have received the 8 lacs cheque from HDFC HOME LOAN OFFICE VIKAS COMPLEX THANE i came to know by the secretary of the society that he received a govt notice on mr NITIN SHETTY`s name claiming he has not paid some stamp duty of RS 1, 08, 000/- on some other property bought somewhere in Goa.

q.1) what should i do?

q.2) will that notice spoil the peace of my mind by sealing my property?

q.3) should i give the cheque (8 lacs) to him & head away for posession of the flat?

q.4) what r the problems that may arise & what is the solution to it?
