DEFECTS/DEFICIENCY IN CONSTRUCTION

We purchased a house from M/s. Covai Property centre based on their promise to provide a quality construction and fulfilment of all facilities and amenities and hand over of the house, as per the construction agreement and other documents provided by you.

RE: DELAY IN CONSTRUCTION.

I purchased a villa B2/2, in thierr Gem Nirmaalayam residential complex and entered into a construction agreement on 05-06. Accordingly, the builder have to complete the construction on or before August.(page 4). After so many requests from my side and so many assurances from the builder side to hand over the villa, by April 20, May 25, 18th July 5th August etc, I was able to occupy the house only by august with more than a year delay as per the contract. I paid the full amount and took possession of the villa from the builder. I have been insisting to maintain the quality of construction, many times in oral and thru mails and many things were given with poor quality finishing, when I occupied the house.

RE: RECTIFICATION OF DEFECTS/FAULTS

I have been requesting the builder to rectify many defects & faults with respect to my villa many times, orally and thru mails, but the response from them is very poor. Some defects, given below are still not rectified.

1. Water seepage at many places. Builder promised in thier mail dated 3th March that they will check the situation by next rainy season and rectify if there is any seepage. Since there was seepage during rains, I informed the builder to rectify the same thru my mail dated 18th November. But there is no response from thier side, till today

2. Cracks in wall found at many places

3. Laying of tiles is uneven inside the villa and at the portico

4. Improper electrical wiring

5. Float valves failed within a short duration at the over head tank and in all flush tanks.

6. Front gate rusted within short duration.

I have sent a request regarding the above by RPAD dated 10-02, but no reply from the builder so for.

RE: DEFICIENCY IN AMENITIES

The cost of my villa includes the following amenities, as per the construction agreement. And as per the legally valid documents provided by the builder, the entire complex should be completed and all amenities are to be provided latest by 30th March. But still they have not provided the following amenities, as per the construction agreement.

1. Intercom system within the colony and with the security gate

2. Electronic surveillance system for the periphery of the colony

3. Facilities like shopping complex, polyclinic etc.

More than 22months elapsed from March 30, due to the delay from the builder side. Instead of rectifying the defects and providing the amenities as per the legally valid documents, builder have collected the entire cost of villa and utilised the funds for some other purpose and left us with so much deficiency.

The response from the builder is also very poor. I hope the realty regulation bill that is to be passed in Parliament will take care of such things and bring to book such unscrupulous builders, under various laws.
