Against SRA Authority-SRA/DDTP /0099/RS/PL/LOI

1. suppose to construct two wings. One of the wing “B” where he had constructed 27 Flats as per the permission from BMC. Builder had made an agreement with all of us (27 Flat members) where it has been mentioned that the land is freehold and belonged to owner, Mrs Lucy D’mello. The building plans had been approved by the Greater Mumbai Municipal Corporation under no EB/CE/A-3386/85/AR dated 1-7.

2. All of us made an Agreement for Sale with the Builder during November/ December. The same was registered with the sub-Registrar, Bandra. In the agreement no where it has been mentioned about SRA nor we were knowing that the building will cheat with us.

3. All of us have paid full and final payments to the builder during March since the building was ready for pocession. All of us are staying in the said building during April- June.

4. Builder had not taken interest to form the society since last four and half year.

5. He argued in number of meetings held with us on society formation on the ground that he has to construct another wing “A” as per the brochure. Since TDR is not available he is not able to construct “A” wing. He assured us that he will form society once proposed “A” wing is over.

6. Since the builder did not do anything, we approached to the Dy Registrar during June. Building filled a petition to the Dy Registrar stating that the project is under SRA and he has the approval to construct 2 more wings on the same plot instead of one. It was just like we all were fallen in earth from heaven. All of us were shocked to heir that the project is under SRA! Builder is suppose to inform us before he makes the project under SRA! This shows that there is no law and order in the country or he should be punished in such a manner that not only he but the entire community dare to do this kind of mischief in future.

7. As per the paper submitted by the Builder to the Registrar office, we understand that the project is approved by SRA during November.

8. Also you have given sanctioned to Construct Plinth during July.

9. We would like to summarise the facts as explained above:

Plot of Land bearing CST No 637

BMC approved the construction 23-12

Freehold Property owned by Mrs. Lucy D’mello

Approval by Maharashtra Town Planning Authority

Sale of Agreement deed made November/ December

Full & Final payment to builder March

SRA approval November

SRA approval for Plinth July

Apply to Dy Register for

Formation of Society June

SRA approval disclosed by builder July

10. If the project was approved by BMC as a Private Property then how can it be converted to SRA! You have to tell to media as well that your job is to earn money from builder and care nothing about poor people who lives in Slum.

11. We, builder, BMC, SRA & Registrar office are involved in this issue. Either the builder has given you incorrect information or manipulated the entire episode spending money.

12. Builder has made an Agreement of Sale as Private Property and then manipulated as SRA after one year. Don’t you think it is cheating, forgery, murdering of law and order, full of corruption, Harassment, Wrongful Restraint, extortion, Mischief as the name you say!

13. Builder is suppose to put notice board at site stating that the project is under SRA in bi lingual as per Para 23 in your approval note. Even today there is no such notice board though he has constructed plinth for proposed Wing “A”& “C”. What kind of role you play! Your role is only to make money from builder. Are you not supposed to monitor the project!
