Sub: - Booking of Flat No 301, at your project Star Enclave, Sec 21, Plot no. 131/132 Kamothe, Navi Mumbai
Dear Sir,
I have purchased the flat no 301, at your coming project start enclave on plot no 131/132, Kamotha, Navi Mumbai and I have made the following part payment towards the total payment of Rs. 8 lacs of above flat.

As per the Last payment receipt dated 13.10. I am ready to make the contribution and have also satisfied all the requirements to get the approval sanction letter for loan from Bank. I am ready to make the payment of the contribution within two month from the date of receipt i.e. 13.10.2010 as mentioned in your receipt.
The bank is asking for the copy of the agreement to be executed under MOFA. I have approached your office and asked Mr. Bharatbhai and Rajeshbhai but they have failed to provide me with the agreement. I need an agreement as per the provision of Maharashtra Ownership Flats (Regulations of the Promotion of Construction sale, Management and Transfer) Act (MOFA) or allotment letter from you stating all the details of the flat, area, total and stage-wise payment to be made etc. without which it is difficult to arrange for the loan.
As the bank loan approval may take time, I have made my own arrangement for the payment of total amount. I am enclosing herewith the letter from my Employer M/S. Malkar Industries stating that they will provide loan for purchase of the above flat. You are requested to let me know the amount payable at this stage as per the progress of the construction work.
Kindly treat this letter as my notice to you for providing me with the agreement as per MOFA and let me know the payment due as per the terms given to other buyers and request you to make the arrangement for the registration of the final arrangement under MOFA for the flat. Once again I am ready to make the payment due at this stage of construction.
You have promised at the time of booking in the Feb that the flat will be ready by Diwali but you only started the Boomi Poojan in July and we request you to now complete the project without delay.
If I do not receive any reply from your side within three days, I shall be forced to move the consumer court for redressal of the matter.
Reply received from builder :
we have recevied amount as below for reserving your flat but you didnt pay as per the schedule. After so many calls from us you didnt pay, so please collect your cheque within 7 days or you will loose your earnst money.
