SUB: Cheating & Harassment by the builder – Leo Land Constructions
We have been living in Leo Land Housing Complex, Tunga, Powai, for the last :
A wing - 10 yrs
B wing - 5 yrs
C wing - one year
There are many things promised by the builder at the time of purchasing the flat which are not fulfilled till date and many of the building works are not given priority by the builder inspite of many requests and reminders.
Though we have paid the entire amount towards the purchase of our flats, Occupancy Certificate it still obtained and the builder is not giving any amenities as we are paying Rs. 2.50 per sq. ft. monthly maintenance charges towards the building.
1) No Occupancy Certificate and the builder has given us the possession on the basis of Legal Undertaking, which says we are desperate to stay in our flat and are living on our own risk in the building.
2) No 24 hrs Security for C Wing, which may lead to robbery in the flats. There is a lot of nuisance at nights by the dogs in premises, which leads us with sleepless nights.
3) The entire premises is unclean, drainages are overflowing, rain water collection, construction material thrown everywhere. Leakages/dampness is found in most of the flats and plastering is falling off, just in the 1st year of occupation.
4) There is lot of rubbish/dirt/debris got collected in the premises building for the past so many years which has made shelter for dogs, frogs, mosquitoes etc.
5) Stilt flooring work of the building still not done and the area is very unclean at C Wing
6) As per the plan of C Wing, the builder supposed to make the portico same as A & B wing, which is still not constructed.
7) NO Elevator in the C wing, though the all the flats /floors in the building are sold and almost 90% flats are occupied, even people are living on the 6th floor.
8) Rs. 35, 000/- towards development of the open space and open parking from C Wing flat owners.
9) The sale agreement is signed between us and the builder Mr. Able George, but Mr, Anthony, the uncle of the builder who also lives in the same premises, 1st floor, B Wing, interferes in all the above building related issue and also an obstruction/barrier for smooth functioning and completion of the above works of the building
Keeping all these issues in mind, we request you to take a necessary action and help us to live in peace and harmony. We have been going through harassment for so many years which we want to put an end as early as possible. We feel that our builder is taking us for granted and misusing our humanity and sincerity and cheating us,
