Subject: Reminder-1 – Wrong / Incomplete information given by the
Ashok Chandwani Proprietor A.C. Associates for booking
flat/shop and cheating for personal gain,
Dear Sir,
This is reference to the letter sent in by my father Shri N.A. Kalra dated May 2nd
wherein he had informed you about the cheating done by Ashok Chandwani
Proprietor- A.C. Associates operating under the address C-201, 1st Floor, Parsvnath
Manhattan Mall, 20-A, Mathura Road, Faridabad, Haryana; for booking flat/shop for
cheating for personal gain (Copy Enclosed).
Sir, my father is a 64 year old man, retired FCI (A Government of India Undertaking)
officer, who has minimal pension from the office. I am at present posted by The
Confederation of Indian Industry in South Africa as Country Representative and the
property was a joint investment by my father with me to secure and support my
future as I am a single mother. Since, I am at present based in Johannesburg; South
Africa my father is the signing authority in my absentia. The dealer in question
(Ashok Chandwani) Proprietor A.C. Associates, C-201, 1st Floor, Parsvnath
Manhattan Mall, 20-A, Mathura Road, Faridabad, Haryana), has cheated and misled
time and time again. A dealer represents builders as they are the first point of
contact for a prospective investor and home owners, hence, we would like to bring to
your attention this problem. We would like to raise an alarm to the KLJ Developers
so that many other customers, like my father, are not cheated by this particular
dealer. We request your intervention in the matter and request an urgent action
taken against the dealer and do justice to this case.
We will appreciate the response shown by company authorities thereby bringing a
hope for justice & favorable action.
Sir, we had booked our dream house with KLJ placing our Faith in you. The booking
is the joint booking on my father’s & my name. My father Shri N.A. Kalra is the first
party and I, Dorin Nelson is the (based out of South Africa’s CII office) the second
party (Customer I.D.- FBD77/SC/043).
Sir I would like to acquaint you with the following facts once again:

1. I had booked a Platinum Plus flat in Sector-77, Faridabad through the above
said broker (Ashok Chandwani Proprietor A.C. Associates). At the time of
booking the flat we were told that the KLJ Developers were constructing a five
storey apartments. After three or four days, we were told that the company has
changed the plan and now are constructing multi-storey building (up to 13th
floors), as HUDA had not given permission for the same and had suggested that
the built up area mustn’t be increased and also required/more green area has to
be maintained. However, it was also suggested by HUDA that the permission
may be granted for to a layout of the building plan which may have more
levels/storeys in the building with the exact/more green area required.
2. When we were informed about the same, we told him that we were not
interested in the multi storey building, then the broker suggested that the shops
are also available in the same vicinity and that he could arrange the transfer
from the flat to the shop, though a payment of Rs. 20, 000/- to Rs. 50, 000/- is
required to facilitate the transfer. He also told us that these charges are
towards the transfer fee.
3. After a few days, the broker came to our current residence along with his
assistant and stated that he has already had a word with the relevant authorities
in the company and they have agreed to accept a fee of Rs. 20, 000/- for the
transfer from a flat to the shop. We paid Rs. 20, 000 in cash to Mr. Ashok and
he stated that the receipt for the same would be provided to us within a few
days. This is to apprise that we have not received the said issued receipt till
date.
4. The flat has been converted to shop and we have paid two installments towards
the same. At the time of transferring of shop, the said broker told us that the
customer discount as decided by the KLJ developers (Rs. 250/- per square feet)
would not be paid to you, as yours was a transfer case. He also stated that he
would also not be paid the dealership commission by the company for the same
case. I would also like to bring to your kind notice that the entire transaction /
dealing was done verbally by the dealer. We had placed our faith/trust in KLJ
through the authorized dealer, Ashok Chandwani Proprietor A.C. Associates,
and are disappointed with the way he has dealt with us and he has also broken
our trust thereby bringing disgrace to the name of your esteemed organization.
5. I would like to bring to attention that the dealer has committed a fraud with us by
conveying wrong / false information to us in order to make personal gains from
us and also making profits from KLJ Developers by misleading its customers
and making most out of the deals specially designed by KLJ Developers for its
customers. This raised a doubt in our minds and heart that there’s something
fishy about the deal and hence, we decided to raise an alarm to the KLJ
developers.
Keeping the above stated facts in view, I humbly request you to kindly treat me as a
direct customer. I would like to request you to kindly accept our request of paying the
installments directly to the KLJ Developers and that we may not be treated as a
customer brought in by Ashok Chandwani, Proprietor A.C. Associates; and that
dealing may be treated as a direct booking with KLJ Developers, as the payment is
being made directly to your esteemed organization.
I hereby request you to kindly consider my plea to:
Adjust the inaugural discount towards my account (towards the shop)
Request you not to release any commission to the dealer as he has brought
disgrace and put the name of your company at stake in his dealing with us,
thereby breaking our trust.
It is the right of the company to decide whether to keep the inaugural discount
amount or to pay it to the customer. However if the company feels that the inaugural
discount is not to be paid to me as a customer, I would like to request that it may
also not be paid to the dealer, as it is not his right to receive the same.
I would like to request you to keep my account for shop and consider me as a direct
customer. A direct correspondence of information would also be appreciated.
I have brought these facts for your kind perusal. I look forward to your support and
request you to kindly take a favorable action in this case.
