Complaint against directors & officers of M/s Majestic Properties Pvt. Ltd for cheating, Fraud & other misc. offences

M/s Majestic Properties Pvt. Ltd. having its Reg. off. At 1/18B, Asaf Ali Road, New Delhi-110002 and marketing office at Village Bhankrota opposite DPS School on main Jaipur Ajmer highway, Jaipur through its directors & officers, hatched a criminal conspiracy and unlawful assembly in order to commit various offences against me and general public. The brief facts of the case are as under

1. That Mr. Rajat Gupta CMD, Mr. Anurag Gupta, Mr. Rajendra Gupta, Mr. Sanjeev Jain, Mr. Anil Bansal, Mr. Prasant Sharma Directors and Mrs. Shuchi Gupta vice president customer care, Mr. D.K. Saxena C.F.O., and other officers of the company are instrumental in inviting & accepting amounts from public on clear & specific assurances that the company has requisite land and have obtained all the clearances & licenses from the JDA and Rajasthan Government and after carrying out entire development work will handover possession of plots very soon to each registrant.

2. That the aforesaid company has issued various advertisements in leading newspapers of Delhi and Rajasthan and has collected more than 50 crores of rupees for the same piece of land in the name of booking of plots and flats.

3. That till Date Company has neither purchased sufficient land nor has got any approvals for the said township and has not delivered anything to the plot booking holders who have booked/purchased plots in the year 2004 to till date.

4. That most of the amount collected in the name of plot booking for Jaipur township has been misappropriated / diverted by the company towards construction of commercial mall at Merrut, to purchase land in Mohali, Karnal, Pune, Zirakhpur etc. and for other personal purposes of directors and officials of the company.

5. After specific and clear assurances given by the directors and officials of the company to me, they introduced me to Mr. Rajiv Tyagi (Kunal Buildwel pvt. Ltd. New Balaji Plaza 34-C, Bhagwan Dass Road, C-Scheme, Opp. St. Xavier School, Jaipur) as authorized dealer of Majestic property pvt. Ltd. I purchased 200 Sq. yards plot @ 4985 per square yard on 20.06.07.Total payment of 4, 92, 000 has been paid given as follows.

- HDFC Bank Demand draft for Rs 2, 00, 000 (No. 029699) dates 04/07 on the name of Asha Tomar.

- PNB Bank demand draft for Rs 1, 25, 000 (No. 071022) dated 03/07 on the name of Asha Tomar.

- I have been told to pay Rs 1, 67, 000 in cash to Mr. Rajiv Tyagi directly. This was been paid in 2 installment as Rs 20, 000 on 20.06.07 and Rs 1, 47, 000 on 25.06.07.

Against the total amount, I have got the a receipt of Rs 3, 25, 000, No. 4268 Dated 06/07/07, from Majestic Properties (P) Ltd.

6. The said booking was arranged by Mr. Prasant Sharma and Mrs. Suchi Gupta as they have informed that the company has closed direct bookings and very soon handover possession of plots so they have arranged the booking from some existing booking holder who was in desperate need of money and willing to sale the same.

7. That for last more than four years of registration even after repeated visits, requests and reminders I failed to get any information from the company for the approvals relating to the said project.

8. That the Jaipur Development Authority has issued a public warning dated 7th June in the leading news paper of Rajasthan to warn the general public that the said company has not got any approvals from JDA and is booking plots by concealing the facts and advised the general public don’t to invest their hard earned money otherwise they will become victim of fraud.

9. That the Rajasthan Government also issued a notification vide serial no. 3 (43) UDD/3 in which it has been specifically and clearly mentioned in para 23 that these all activities are of illegal and covered under criminal act and directed to make enquiry and to take suitable action against the concerned persons/developers.

10. That the information collected from Jaipur Development Authority also reveals that no approval has been granted to the company for any plots in Jaipur.

11. That I have collected certified copies of the Annual Returns of the company filed with the registrar of companies Delhi, for last three years in which company has shown the said booking as “Advance against jaipur project” in the returns of 2005 & 2006 but in the Annual Return of 2007 the company has shown these bookings as “advance against P & F” because in the year 2007 investors has started registering criminal cases against the company.

That the above named company through its directors & officials named above, under criminal conspiracy hatched by them with consultation with each other & with dishonest & fraudulent intention to grab money collected unlimited amounts without having sufficient land & without licenses /approvals from the govt. authorities for the so called entire project. Therefore these persons in furtherance of their criminal intention conspired with each other had fabricated/manufactured documents, cheated and committed the various offenses. It is therefore requested a FIR may kindly be registered against the accused persons & legal action be taken against them in accordance with the law.

The above said offense has been committed by the accused person within the jurisdiction of your police station.
