Not giving agreement even though 80% of total booking amount has been paid

The above builder has cheated my parents who booked flat for 15 lakhs. They took 80% of total amount and not giving the agreement. They have taken the signature of my parents which states that if the PDC to be paid on 31.1.12 gets dishonoured, the total money will be forfieted and booking will be cancelled. Till now they didnot handover the agreement to parents and behave rashly. Plz help us coz even if PDC is encashed on 31 jan what is the garauntee that they will handover the agreement to my parents. In both the ways, my parents are at loss. If my parents block the payment, they will loose whole 10 lakhs and if they give the money, there is no gaurantee that the builder will give agreement to my parents. My father is a retiered officer.
