I did my booking in Earth Towne on 17 Aug and after repeated request for documents for availing home loan from Air Force Group Insurance Society I received the receipt of the BOOKING AMOUNT dated 03 Sep 2010 on 20 Jan when I physically went to their office at 26, 1st floor Pusa Road Karol Bagh, .
I was in regular contact with Mr. RK Arora, (then V.P customer support) and Mr. Kasib Khan (their marketing head) through e-mails and telephonic conversations and I was assured of execution of my Builder-Buyer agreement as soon as possible along with other relevant documents required for availing house building loan, as I had opted for DOWN PAYMENT plan.
Somewhere in mid of Apr I received another communication from Earth Infrastructure, intimating change of whole plan and allotment of new unit and assurance in writing about immediate issuance of Builder-Buyer agreement for which once again I visited their office and I was conveyed that they were in process of disbursing Builder-Buyer agreement.
I kept waiting for Builder-Buyer agreement and other relevant documents from their end despite numerous reminders sent to them from my end, primarily to avail loan and fulfill the required payment, but neither did I received any Builder-Buyer agreement nor any demand from their end to furnish the payment.
Despite being aware of the fact, that the customer is going to avail House Building Loan for the above mentioned unit, there was delay, rather they failed to provide me with the Builder-Buyer agreement with false assurance of executing agreement “as soon as possible”, whereas rest of the document required for the loan along with No Ojection Certificate to Mortgage and Tripartite Agreement executed on stamp papers and duly signed by authorised signatory Earth Infra were provided.
Since Aug till date numerous telephonic conversations, communications through mails have been done from my end and despite paucity of time due to nature of my job (and being posted outstation), I have physically visited your Karol Bagh office eight to ten times, Naraina office twice and their Noida office once.
On 23 Sep 12, I received a communication dated 28 Aug 12 (where as letter was dispatched on 17 Sept 12 from Earth Infra as per First Flight courier records, after updation of my change of address on 15 Sept 12), stating cancellation of my booking ETH/2358 on the ground of delay in outstanding payment. I immediately replied to them stating my case as I have presented here but I did not receive any communication from their end again I sent a reminder of the same after around ten days and I am still waiting for their reply.
With the above mentioned facts it is amply clear that I should not be held responsible for the delay in payment from my end and my booking should not be cancelled. I am feeling as if I have been cheated by EARTH INFRASTRUCTURE as they did not send any communication when Noida Extn case was on in court but the moment some clarity was expected and rates started appreciating they started dishing out letters regarding cancellation of booking. Also, I am a combatant member of Indian Air Force in flying branch and nature of my job doesn’t allow me to frequently make such visits. Such issues not only affect one’s performance but also put immense mental pressure and increases risk involved in my job.
IF A COMPANY "NOT EVEN PROPERLY ESTABLISHED" IS HANDLING ITS CUSTOMERS LIKE THIS, THEN GOD KNOWS WHAT WILL BE ITS FUTURE... THEY ARE NOT EVEN BOTHERED THAT THEIR FIRST EVER PROJECT ITSELF IS STUCK AND THEY ARE ILL TREATING THEIR CUSTOMERS AND THEY ARE LEAST BOTHERED ABOUT THEIR IMAGE..
