It is very sad that I have to place a complaint before you, regarding something which I have recently discovered is very controversial. But, what is more dissapointing is that the show is still aired in the channel, and the show owners continue to fool innocent people like me into believing that we can actually win the amount specified by them if we hold the line.
According to section 90 of the Indian Penal Code, which states that a consent is not such a consent as it intended by any section of this Code, if the consent is given by a person under fear of injury, or under a misconception of fact, and if the person doing the act knows, or has reason to believe, that the consent was given in consequence of such fear or misconception.
The person on the other side, just creates a "misconception" in the minds of the callers, telling them to hold the line as they try to connect to the studio. They also suggest that the callers might be rewarded for being patient and smart by not letting go of the connection. This definitely leads to the creation of a gross misconception in the minds of the callers who feel that their calls will be answered anytime soon, and expectantly wait on the line.
According tyo section 415, Indian Penal Code, whoever, by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any property to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived to do or omit to do anything which he would not do omit if he were not so deceived, and which act or omission causes or is likely to cause damage or harm to that person in body, mind, reputation or property, is said to "cheat".
And the explanation provided is, a "dishonest concealment of facts" is deception within the meaning of this section and the punishment for cheating is laid down in section 417: whoever cheats shall be punished with imprisonment of either description for a term which may extend to one year, or with fine or with both.
Lastly, section 420 states that whoever cheats and thereby dishonestly induces the person deceived any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.
Here they are guilty of dishonest concealment of facts as they do not at any point of time make any mention about the charges charged, like 10 or 12 rupees per minute, which I can confirm, being the sufferer myself as Rs. 60 got deducted after 5 mins. They do not warn us about it at all. This would obviously hinder their source of money supply if the people would disconnect their calls sooner.
Thus, they dishonestly induce the person into believing that their calls would get connected while deducting so much without prior notice, to make the caller aware about the charges.
I request you to kindly consider the matter, and take acvtion against them immediately, so that more people are prevented from being cheated.
Being an aspiring lawyer myself, I request you to admit my complaint as we students are the torch bearers of the future, but without the giudance of our elders, we would not know the way. Please show us the path of justice.
