I Francis Domnic Santamaria am staying in &&-H5/58 Vishalgad society, Swami Vivekanand Nagar, Pune Sholapur Highway, Ramtekadi, Hadapsar-13, &&since from 1995 along with my brother we are in blood relation, it is our own flat, later in 2002 as i got married my wife came to stay with me and my brother left to Newzealand 2002 for good, i have a ration card an election card with the given address from i am paying the maintance money to the society fom my own pocket since then.
1) Nuisance carried out by the tenant, unauthorized use of flat by tenant without any NOC (no objection certificate) given by the society to the owner of the flat neither any permission taken from the members of the society, no police verification documents SUBMITTED to the society by the owner of the flat. Extra parking space used by the tenant and their relatives, they park the vehicle where ever they want, and no space left for the owner of the flat to park their vehicle.
2) Tenant Threatening our children all the time from playing on the terrace/ the tenant husband and wife assaulted my wife 3 times without any reason, when i was not present, this was done in the presence of the society members, society is ristrickting me from giving complain to the police, as they have not followed the society rules and regulation since registration was done.
3) Tenant Creating noise after prescribed deadline hour in the evening very often, intensionaly trying to make noise in some way or other. Damaging our private property like bike, scribbling on our wall which was just painted one year back. Dirting the stair case, throwing dirt, spiting in front of the door, banging the feet while climbing the staircase and going down,
4) Tenant using Verbal language (Fillth language) when spoken to, informed the owners relatives and also the chairman. Tenant getting unknown people in the society. A characterlist tenant staying in the society so you understand what do i mean by...
The VISHALGAD H5 Society Chairman Mr Hanumant Phadtare and its Members were informed about the MIS- BEHAVIOUR of one of the tenant staying on rent, he was told VERBALLY and even by REGISTER AD LETTER, and they have even seen with their own eyes and heared with their own ears while the fight was going on between us and the tenant, but still no action was taken by the CHAIRMAN nor by the members of the society against the tenant, i had requested to remove the TENANT from the society which they didnt do so, but instead they are telling me to wait for 4months and later they will vacant the flat, this was not the answer that was expected from them, then why is the society formed, why is the tenant given more preference than a owner, why is the society entertaining 3rd class people in the society, without taking permission from the member of the society staying to allow to keep tenant or no, and if yes then why no rules are made for them.
Complaint to Registrar is to be made on the matters of:
1) Non maintenance or incomplete maintenance of records and books.
2) Investment of funds without prior permission.
3) Non maintenance or incomplete maintenance of records and books.
4) Misappropriation of funds.
5) Non supply of copies of record and documents.
6) Registration of society on misrepresentation.
7) No action taken against tenant mis-behaviour.
8) They dont consult the members of the society for anything before doing.
9) No rules and regulation laid for the tenant.
10) No society account opened in the bank, No original receipt given after payment taken.
11) Not allowing authenticated use of the available open space of the society by managing committee
12) Giving permission to built illeagal construction
