Harrasment over Phone/ECS not working

Dear Sir,

This is with reference to the car that I purchased in 2008 from Chevrolet showroom in CP. At the time of purchase we were approached by the executive from Family Credit Bank sitting in the same showroom for offering loan against the purchase. Although the bank was unknown to us but still we were persuaded to take the loan from them as they assured the best of services to us.

We took a loan of 1 lac from them & a monthly emi of Rs 2350/- was fixed for a tenure of 5 years. I got the ECS done from my salary account on 5th date of every month. The first emi was debited the on 5th August-08 . Everything was going smooth for next 8 months after which the amount did not get clear from my account. I checked my statement and called the executive (who was hard to trace) regarding the same. The executive said due to some system error, the emi would be debited next month. To this I requested the bank representative to please send someone to collect the money from my home as I have a limited salary and would not be able to pay two installments together. No one came to collect the installment neither it got debited the next month. I again called to send an executive to collect the installments which were pending for 2 months. I was told that an executive would visit in 2-3 days and would collect the same. Nobody turned up for next one month, neither the amount was debited. The same continued for 3-4 months, when an executive by the name Laxman Negi called us and started talking in a harsh voice saying that we have bounced the cheques and need to pay the amount in one go for all the installments that were not paid from our side. I told him that this is absolutely wrong statement as my account had enough balance for the installment but he did not agree and asked to pay the pending emis together. I requested that as i am a service class person therefore I cannot pay all the pending emis together but he was very rude and started threatening us, we even have the recordings for the conversation with him where he has been talking in a very indescent way. As we are very simple, self esteemed people therefore we did not argue with him and agreed to give the money as per he said, at the same time I also requested him to get my ecs started again as I am facing a lot of problem with the same. He said that I will have to fill the ecs form again and get it attested from bank and submit it to get the facility started again, to this I said that I have already given these papers at the time of taking the loan but he said that due to some error at THEIR END they would be needing it again. Anyhow I got the formalities done and handed over the ecs form again hoping that things will fall in place. Next month the same story repeated and my installment was not debited, I called to ask the problem. Laxman said that there has been some problem again at THEIR END due to which they would be needing to get another ecs form filled. I got really frustrated and after much discussion I again got the same done. In the meanwhile all my installments were getting pending which was again a cause of worry for me. One fine day laxman asked me to pay all the pending installments before starting the ecs. I said that I would surely pay my pending emis but not in one go as I do not have the finance available however I would pay one by one. Hearing that he again started shouting and threatened us to pick our car. At last i asked him to send an executive to collect half money and rest half I would pay later, in the mean time the ecs would also start.

My ecs did not work the third time also. Laxman left the organization and never called again. We even went to the showroom to speak to the company execs but there was nobody sitting there. I was unable to locate any body for next 6-7 months. Neither anybody called from the company for follow up. Today after about an year has passed, another executive named Amit called and asked to pay the money. He has been calling continuously for the payment. At first we tried to explain our problem to him hoping that he might help us in getting the same resolved but on the contrary he raised his voice at my father who is a retd govt officer and my mother who already doesn’t keeps well. He has been demanding money against all the pending installments, only after that he would start my ecs again.

This entire experience has left us in such a frustrating situation that we are unable to take out a conclusion. If there has been an error from the side of the bank then why should we be penalized when we are not responsible for any default. I want to know what is the use of such a loan where I have been threatened to pay the amount in one go. Moreover I have been so frustrated with this bank that I have lost all trust with the services of it and do not want to continue any association with this. I am writing this letter thinking that I will surely get a positive response to my problem. Shall appreciate if my complaint is looked into and resolved asap. I would be lodging this complaint in RBI & Ambudsman also as this is a case where the consumer has been exploited and threatened without any fault.
