Sub: Grant of Fixed Medical Allowance (FMA) to the Railway Pensioners&-mdash;request to arrange Payment of Arrears from 01-9 to 31-8 and to continue in the Monthly Pension from Septonwards-Reg.

In continuation to my letter dated 31-8, and In reference to the above, I am enclosing some of the relevant letters appertaining to the FMA which are self explanatory.

1. Dy. Director, V Pay Commission, Ministry of Railways, Railway Board Lr. No. PC-V/A/Med./1 dated 13-8-- addressed to all concerned&(gist:

self certified undertaking furnished by the pensioners to the concerned PDA and the PDAs are not competent/authorized to question the details filled in the Undertaking form…As such, the undertaking as filled by the pensioner… should be entertained by the PDA concerned without questioning the details filled therein…);

2. CPO/S C Rly./SC letter No. SCR/P-HQ/650 dated 03-12 addressed to all concerned;

3. FA & CAO / South Central Railway, SC Letter No. APN / RO1 / Med. all.-dated 03-7 addressed to the Managers of All Link Branches, and others concerned& (gist: Para-3—This office (FA & CAO / SCR / SC) need not issue letters to each and every pensioner on the eligibility for FMA….Hence you (Banks/PDA) are advised to pay the FMA of Rs.100/-p.m. to the pensioners who opted for Health Scheme and residing outside the Jurisdiction of Railway Hospital/Health Unit…):

4. Director, V Pay Commission, Ministry of Railways, Railway Board addressed Letter No: PC-V/A/Med/1- S .No: PC-V/505- RBE No: 83 dated 07-6 addressed to all concerned—(gist: … to ensure that the pensioners... availing OPD facility for chronic diseases are not deprived of the FMA, … the pensioners who opt to claim FMA should submit the undertaking Form to the concerned PDA …);

RBI Brno. RBI/296-DGBA.GAD.No. H.11303/45.01.003-06 dated Feb 06 addressed to all Pension Paying Banks& (…In order to obviate the time lag between the issue of Orders by the Govt. on DR and OTHER ALLOWANCES ETC., Pension Paying Banks had been advised… to act directly on the copies of such orders which may be supplied…..without waiting for receipt for further instructions from RBI…

In accordance with the above, I have submitted my self declaration/undertaking form for further necessary action at your end please. I submit that I have not claimed this Fixed Medical Allowance from the date of my retirement- that is from 01-9 till date. Hence, I request that the arrears acquiring from 01-9 to till date may kindly be credited to my SBI/Lalaguda Branch- Savings Account No: 30056159723 maintained at yours; from 01-9 to 31-8 at the rate of Rs:100/- per month and the enhanced amount of Rs:300/- from 01-9 to till date, and to continue the same.

Honoured Sir, Sub:-Denial for payment of FMA arrears by SBI/CPPC, Mushirabad, SC – reg.

It is to inform that in order to get Fixed Medical Allowance with arrears, as was given and giving to all I have also applied duly filing application and the undertaking form on 31-8 and followed by detailed letter dated 22-9 to the SBI concerned Officials. I have submitted the application in duplicate with all the relevant documents and the Undertaking Form to the concerned SBI. Lalaguda Branch authorities for payment of FMA and the arrears accrued thereon from my retirement day- i.e. from 01-9 to 31-8, Other Pensioners drawing Pension from SBI Bank/Branches have also applied on the same lines; it was brought out that no pensioner is being paid arrears. As there was no response on the issue, on 28-10 I have attended the SBI/CPPC Office, SC and met the concerned officials on the payment of FMA and the arrears, but the concerned Officer, Sri. Rajender had informed that as per the Oral/telephonic Orders received from Sri. Ganeshan, FA&CAO/SCR, SC ‘no arrears shall be paid and only FMA shall be granted from the date of application’ and that for me the FMA, Rs. 300/- Per month has been included in the monthly pension from the Month of Oct.

When I have drawn the attention on Para No. 3 of the ‘Undertaking’, issued by the Ministry of Railways. which clearly indicated about payment of the FMA arrears also as per the claim from the date of retirement, he categorically informed and suggested that the matter may be brought to the notice of the FA&CAO/SCR, SC (Sri. Ganeshan) and others too, who had directed them not to sanction/include the arrears as the Railways is incurring lot of financial inflation and to be curtailed through this type of FMA arrears non-payment. This is nothing but by using Power of Authority and selecting due discrimination and differentiation amongst Pensioners and the PDAs in a selected mode of repression, etc in India. Only selected shall be deprived of the privilege granted by the Govt. of India.

He also informed that there are no written Orders/letters from the FA&CAO/SCR, SC but they are honouring the words received on phone information, and not paying any arrears to any Pensioners. When I brought to his notice that some other Banks have already paid and also paying the arrears on FMA in these recent months, he informed that he has no say on the same.

In the circumstances, I earnestly request you kindly to do the needful by making a reference to the concerned Railway Authorities or any other whom you feel fit and proper on this issue as to why the SBI/PDA-- CPPC, SC should honour the oral/phone directions having no confirmation copy in writing and to be applied to whole of the Pensioners alike in India, and the Bank declining to pay the arrears and why the FA&CAO/SCR, SC has directed and ordered not to pay the arrears of FMA to the Railway Pensioners drawing their pension through SBI Bank branches, why not his be deplored from your side and from the RBI also. I pray to do the justice.

Sir,

I am sending a copy herein for favour of information and further necessary action at our end, with a hope that still justice and equality before Law remain with you, at least.

I personally feel disgusted and astonished to hear from your authorized officials that even the Bank Authorities are lurking around the oral instructions also, making the Pensioners to move around them, for the reasons best known to them, and with the attitude of the Officials of the SBI for giving so much of weight-age on the oral/phone Orders/Directions, if any, and adopting to discontinue at mass and one sided decision only to make the Pensioners of the PDA/SBI Branches to feel individualized and discriminated and separated from the other Pensioners of other sister Banks in the City and in India. This action is nothing short of exspatiari.

Let there be at least one Policy adopted by you with a definite bench mark date to give arrears to the eligible Pensioners applying for FMA. While other Banks are giving and respecting the Ministry of Railways and that of the RBI Orders on the matter of sanctioning /crediting arrears of FMA from the date of the claim, that in the prescribed and formulated proforma, and your authorities just ignoring the same and in particular PARA No. 03 of the Undertaking, is beyond imagination of your thoughts and aspirations in denying and refusing to honour the Ministry of Railways and others Orders / Directions etc.

If you all feel that by paying arrears the Government is losing its revenue and funds inflated, then chalk out a Policy to be applicable to one and all, but not like this type of tactics in showing favoritisms and the like from Bank to Bank and from one place to the other in India. Status, Dignity, mysticism in the working system, Values and accountability is going to be lost for ever. No one shall thieve around for money sake, it is the privilege given the Government and the same shall not be discriminated and on influence.

Hope at least you can help us in the matter.
