Sub: UNAUTHORISED CONSTRUCTION OF THIRD FLOOR OF PROPERTY NO K-1, KAILASH COLONY NEW DELHI BY SMT USHA DEVI SHARMA.
Sir,
Smt. Usha Devi Sharma is the owner of the rear portion of second floor only, whereas she has covered one half of the staircase in her portion and despite that she is not the owner of the third floor, she has also raised constructions un-authorized over the roof of the second floor, which is meant for the common use of all the occupants/ residents of several portions of the whole property No. K-1, Kailash Colony, New Delhi-110048.
The said Smt Usha Devi Sharma was requested not to raise the construction of the third floor since the foundation of the whole building is very old and there is every risk that the whole building can fall because of heavy load. There are no columns in the building and it is load bearing only.
Smt. Usha Devi Sharma, Ved Prakash Sharma, Hitesh Sharma and Vinod Sharma fabricated the sale deed from 400 sq feet to 900 sq feet and malafidely did not filed copy of site plan in the MCD and get the plan sanctioned from MCD. Hitesh Sharma and Vinod Sharma are also in conspiracy with Usha Devi Sharma and Ved Prakash Sharma in committing the offence described of.
Through we brought the said fact to the notice of court but the Civil and Criminal procedures as per the law by Supreme Court may go side by side.
Smt. Usha Devi Sharma, Ved Prakash Sharma, Hitesh Sharma and vinod Sharma have committed punishable offence under several sections of I.P.C.
It is, therefore, requested that the said Smt. Usha Devi Sharma may kindly be directed that she should constr5uct only her portion and not the stairs and the third floor which are not owned by her and demolish, seal the third floor and file a Criminal F.I.R. against them.
