The aforesaid loan has been taken as on 8th May from Cholamandalam DBS, for a period of 3 years for an EMI of Rs. 4512/- to be represented as on 5th Of Every month to be started from June 5th - 2008.Till the date all EMI’s were cleared properly.

As on 5th April, one of the EMI got bounced as there was strike going on in Hyderabad city and banks were closed & we were not able to deposit the money in bank. For which we called your customer care after two days, which told us that there is no system of representation of EMI which we asked for and we were told that some will call us as an when they will get update on EMI bounce. After 5days we got a call form cholamandalam DBS regarding EMI bounce and they told us that an executive will be sent and payment can made to that person. We asked about EMI bounce charges on the call the person told that there will not be any EMI bounce charges for the first 2 EMI bounces, however we were clearly told that in the beginning that the EMI bounce charges will be there but they did not communicated the exact amount. An executive was sent by cholamandalam as on 14th April and payment was made to him in Cash vide receipt no.1890133 to Mr. Suresh (Ph: 9396394998, 9951685680) and we also asked him about the EMI bounce charges he also told the same thing as above. So my emi for April which was bounced got cleared and no amount was due on behalf of myself.

As on 20th April when I checked my SBI bank account No.30018731290 from which cholamandalams EMI was cleared through ECS, there was an entry of representation of EMI of Rs.4512 of choalamandalam DBS. As I thought my EMI is up to date I have issued a cheque of Rs.6000/- to others was bounced and the person whom I issued the cheque called me and started yelling at me. This all because of you guys and because of not proper customer service.

When I called customer care toll free no. of cholamandalam on 1800 425 4565 around 4pm, Indian Standard Time as on 23/04, and talked with executive he told me that there was a technical error from cholamanalam side and due to which the emi has been represented... and they are sorry for the inconvenience caused to me, When I asked for a complaint no. she said there is no system of complaint no. Loan account no. is only complaint No. and they gave me the Hyderabad office contact numbers to contact them for refund of mine extra EMI paid for that month.

When I called them and gave my loan reference No. they told that they haven’t got any information regarding the ECS representation and were telling that if we have any proofs of bank statements they asked us to come with those things. I went there and provided the bank statement of my bank they told that we will get an checque of EMI in 10dys which has come and they were telling that we have to pay the EMI bounce charges in reply to that we told them what we have been communicated with there agents on the call which we have got form cholamandala DBS.But the Team leader of Hyderabad office was saying that as this was the mistake from there end he told he will forfeit the EMI bounce charges but he failed to do so and they were also collected the interest for EMI bounce charges and refunded the remaining thru checque No – “019591” 600240002 903369 30.

And I have taken the statement form Cholomandala DBD and in that there is no entry of ECS re-presentation on 20/04 where as it should have been in there records, however they have an entry of the refunded checque I don’t know why. If they do not have entry of ECS representation they should not have refunded checque. I don’t know why? Even I am attaching the copy of that statement with this complaint.

Here I have a question for you as communicated to us by the agents that there will not be any EMI bounce charges what would be my situation at the end of my loan period? I have paid a interest of Rs.49/- towards EMI bounce That may look small now. How much they would have done by the end of my loan period by calculating your unknown interest rates.

I THINK THIS IS A REALLY GOOD PLAN OF YOUR COMPANY TO SQUEES THE BLOOD OF CUSTOMERS.

There is a mistake in your system, first you say there is no representation of EMI then you represented it.

Payment has been made, but the system was not upadated... Updating system is your job, not of customers. I don't operate your computers.otherwise I would have done by myself.

Your executives accepted that there is a clear technical error in your system due to which the EMI was represented inspite of saying no and inspite of making payment.

A lot of inconvenience has been caused to me. And has to listen to the yelling of persons to whom I have issued the checque.

Compensation has to be paid on the following grounds:

For inconvenience which has been caused to me due to disnonour of ECS without consent and due to technical mistake in your system.

Wastage of Time in talking and arguing with your customer care executives.

Writing this email and sending it to consumer court.

Towards my personal checque bounces charges.

And most important spoiling my bank statement and bringing down the reputation and goodwill of myself.

Kindly take down my written request for foreclosure of this loan and refund me the compensation amount. Your sorry is not enough. If I delay your payment and say sorry then you will accept my sorry only with late fees charge Right... so similar rule is applicable to you.
