Brief Details of the Case ….
I have been victimized by one of Mumbai based Garment co.[Gini and jony- franchiser] Despite Issuing commitment confirmation, not ready to refund 7 lacs Security Deposit.
1. I intended to open a franchisee store of Gini and Jony in Gulbarga so got in touch with Mohan Sundaram (Gini and Jony ASM South India).
2. Shared location information and finalize the deal with 12 Lacs to be given as security deposit and cost of interior to be bear by us.
3. My property at Asian Mall Gulbarga, Karnataka was still under construction and at final stage at this time of finalizing the deal.
4. Paid 2 lacs on 30-Aug by Cheque.(Hurried up request made by Mohan Sundaram, to whom i blind trusted)
5. Paid 5 Lacs on 31-Mar by RTGS bank transfer.(Hurried up request made by Mohan Sundaram, to whom i blind trusted)
6. Paid 5 lacs on 21-May by RTGS bank transfer. (Hurried up request made by Mohan Sundaram, to whom i blind trusted)
7. Repeated request made to issue receipts for the amount paid but no response at all.
8. Repeated request made to make agreement but no response.
9. Repeated request made to provide proper store interior plan as per standard operating procedures but ask us to use other store design concept.
10. Untill 27th Feb no receipts were issued and no agreement has been provided by Gini and Jony.
11. After all this non ethical business practices made me to rethink of opening a Gini and Jony store and at last finally decided to cancel the deal.
12. At this point no agreement was made so there was no bounding and compulsion from my side to continue.
13. On 27th February i sent an official request to refund my entire security deposit of 12 lacs hence i am no longer interested in Gini and Jony. Which i believe is my right.
14. On hearing this cancelling of the deal they started behaving very rude to me specially ASM - South Mohan Sundaram (ASM Bangalore).
15. After huge correspondence on phone calls and emails for 1-2 months Gini and Jony finally agreed to return my security deposit in 3 installment (May-June-July) 2012.
16. I received 1st Installment of May 0n the 31st day of May and that too i made repeated requests.
17. Gini and Jony again gone back to square one and what they are at best making false promises and lies.
18. As of today the 3rd Aug they have not paid my June and July security deposit installments worth rupees 7 lacs.
19. This is the business ethics of a 400 crores organization.
20. After 100s of phone calls and 10 of emails, Jay Lakhani responds occasionally with one word contact Mohan Sundaram in Bangalore, when we contact Mohan Sundaram in Bangalore he will say let me speak to the management, after huge correspondence on mails and phone calls Mohan responds (after so many lies) another lie that management is willing to pay and they will give the refund dates shortly, what a nonsense.
21. Every day, every time Lies, false promises is become their new trade mark.
22. Some how government should teach a lesson to this white collar criminal minds of Gini and Jony for harassing innocent and new entrepreneurs.

01. Company has to refund my entire security deposit of 7 lacs rupees along with interest till date.
02. Company has to return me Three SIGNED undated Blank Cheques, held with them.
