Sub: Harrasement by ICICI Bank Officials on account of Credit Card No. 4864103139719008
Dear Sir,
My Name is Vishnu Kant Mishra. My Brother had with whom I am no more in touch with due to family reasons had made a ICICI bearing the above under subject above which was not under my knowledge and I was also not aware that he had some outstanding with the bank on that no.
Few days back I received a call from some Mr. Manish Kumar from his personnel mobile no. i.e. 9711770184 and claimed to be a Collection Agent of ICICI Bank located at Rohini Branch of ICICI.
He used very abusive language about my brother and my Father (who is no more with us) and told me that he has collected lot of information about myself and my family from my details and telephone numbers in which my address and father’s name was same and forced me to give numbers of my brother.
I told him repeatedly that now I am not in touch with my brother and I am not responsible for his actions and deeds and he should not call me because as per my knowledge “Third Party Calling” is not allowed.
He kept on calling me again and again and used very abusive language and kept harassing me and then after few days he told me that he has arranged for my phone bill and will call on frequent dialed number from my bill and he started calling those people whose number was in my frequent dialing list.
He even called my relatives and my friend in Banglore and told all crap about me and my family. The I again called him and told him not to do that and he started blackmailing me and forced me to settle the amount which is not my responsibility.
He is everyday calling me from his personnel number and humiliating me. So I am writing this mail to you people to please help as I am working as an Engineer in a reputed firm and these kind of calls during my office hours always create nuisance and I am always humiliated for something I have not done.
Please clarify as what actions I am liable to take on account of Blackmailing and Extortion as bank cannot call on my telephonic list and contacts as I have not made the ICICI bank credit card and is this the way the Bank behaves and also is it as RBI Guidelines (Fair Practice Code for lenders (circular DBOD. Leg. No. BC. 104 /09.07.007 / 2002–03 dated May 5) as also IBA’s Code for Collection of dues and repossession of security. In case banks / NBFCs have their own code for collection of dues it should, at the minimum, incorporate all the terms of IBA's Code.)
I would request the Bank to please initiate the proper actions in this regards or I will be forced to initiate legal actions from my end
