Sub.: Complaint against M/s. Nagarik Sahakari Bank Ltd. for whimsically increasing in interest rate.

Respected Sir / Madam,

That the applicant hereby submits his complaint, stating as under :

1. That I am a peace – loving and law – abiding citizen and having great respect and reputation in society and am currently the Head Master in a Municipal School at Bhiwandi and going to retire in the year June.

2. That I have took a Housing loan (HSGCUS – 30/3) of Rs. 3, 00, 000/- from one M/s. Nagarik Sahakari Bank Ltd., Bhiwandi on dt. 25/10/04 and as per the document issued by the said bank, it was stated that I shall pay Rs. 4, 000/- per month at an interest rate of 10% as EMI through Daily Collection Scheme firstly through A/c. No. 3805, of the said Bank through Mr. S.R. Ansari – 15 and presently, through A/c. No. 33000586 of the said Bank through Mr. Alkama Mohd. Haroon Momin, a Bank Agent and further, I was issued a share worth Rs. 7, 500/- and further processing charges of Rs. 1, 000/- was also charged by the said bank.

3. That therafter, as per the say of the said recovery officer, Mr. Kamruddin Ansari, I had deposited Rs. 7, 000/- on dt. 5/1 and Rs. 5, 000/- on dt. 7/2.

4. That thereafter, as per the said letter/document of dt. 25/10/04, I was regular in payment of the said EMI as per daily collection scheme, but, in the moth of April, the loan recovery officer of the said bank, Mr. Kamruddin Ansari had asked me to approach him at the bank and told me that the EMI of the loan taken by me is not Rs. 4, 000 but Rs. 5, 300/- and there is a overdue interest of Rs. 50, 000/- on the same.

5. That thereafter, I had met the said recovery officer of the said bank for 2 – 3 times and told that as per the document / letter issued by the bank of dt. 25/10/04, the EMI is Rs. 4, 000/- and further, told that I am going to pay the remaining EMI even after my retirement, on which, showing his wicked nature, the said recovery officer in a very harsh tone told, “[sakI @yaa gaOroMTI hO kI tuma irTayar haonao ko baad maoM BaI hfta Baraogao Æ ”, which further amounts to mental and physical cruelty.

6. That I have quite many times on cell phone and also tried to meet him and have given the same reply that as per the documents, the EMI is Rs. 4, 000/-, but, the recovery officer put a deaf hear towards the same.

7. That the said recovery officer had quite many times approached me at the school premises, where I am the Head Master and being in such a noble profession, I am being made as a thief by the said officer, as such I have done theft in the bank and the said recovery officer is degrading my reputation in the school premises also, which is nothing but mental and physical torture to me.

8. That, I have given various applications and letters to the said bank, even a complaint against the said recovery officer on dt. 22/8 and also regarding the whimsical increment in repayment amount, but, no any action has yet been taken by the same and they are putting me in doldrums now and then.

9. That I have further given an application under the Rights to Information Act on dt. 22/8, but, I have been only issued a reply that our bank does not comes within the purview of the said act.

10. That, as and when I shall return from the post of Head Master in the month of June, the bank officials with such tactic and whimsical nature would at any moment create problems to me, which would not be as per the rules and regulations of sanction of loan amount, which is not complied by the bank officials, i.e., the document / letter of dt. 25/10.

11. That, now, with this present application / complaint under the Banking Ombudsman Scheme, I hereby request you, the above authority to take appropriate legal steps against the said bank and its officers and ask them to go by the rule book and accept the EMI as per the document / letter of dt. 25/10 issued by the said bank and not the said amount of Rs. 5, 300/- and further, the reasons as to why the bank overdue amount was charged on the said loan by the said bank without any just and necessary cause and if no any action is taken by you, the above authorities under the Banking Ombudsman Scheme, then I shall be constrained to take appropriate legal steps against the said bank in the Hon’ble Consumer Forum, which please take note.
