Cheat, Fraud & delay - not responding to give me refund of Booking Amount

Dear Sir,

A number of complaints have been posted against A1 Hyundai Saki Naka, and now I am thier latest victim,

Could you please adivce, how should I get my refund of my booking amount from them.

Following is the communciation which I have send to Hyundai, A1 Auto and have been calling them begging for my own money

1st Complaint that I had send to Hyundai (Send on 19th of April)

Cheating by your dealer A1 Hyundai

This is complaint which I need to make against your dealer of Mumbai A1 Hyundai Saki Naka.

Being impressed by your Santro, I went to your authorized dealer A1 Hyundai at Mumbai Saki Naka on 16th of February.

After discussion with the sales executive, Mr Lucky, I decided to buy a car in the name of my wife Pratiksha Sodha (Berry Red Santro, GLS Version, having both Petrol & LPG fuel options.)

I paid instantly a deposit, of Rs 50, 000/- to Mr Lucky.

The car was promised to me within 3 to 4 weeks.

After 3 to 4 weeks, whenever I called Mr Lucky, he said he will get back to me, but did not give any dates on the car. I kept on calling and calling, and two months passed, there was no commitment, no response.

The I discussed this case with Mr Girish Naik - Sales Manager of A1 Hyundai.

He tried to take up this case nicely, but unfortunately only tried to cover something wrong that has happened to my order.

He tried to offer me GLS Berry Red Santro with only pertrol option and that too on the condition that I will have to pay the increase in the price, that has happened after budget.

Later on they some how they tried to convince me to cancel the booking, this left me with no other option and I decided to cancel the booking. I spoke with CEO of A1 Hyundai and he said he knew everything, and he cannot offer any compensation.

I am completely frustrated and disturbed/upset on this treatment by your dealer.

I have been calling Mr Girish Naik, and he promises to give me my booking amount of Rs 50, 000/- back within 4 days.

Today I called him after 8 days, and he says call me again in one & two days and gives me genuine reason there are no funds with A1 Hyundai to give me back.

I being an ordinary person, with all my hard earned savings, went to buy a car from your authorized dealer.

Unfortunately I did not get the car, but also my booking amount of Rs 50, 000/- is with them since past 2.5 months and at present they are saying call us after some time.

Now I have my own doubts will they give my funds back even after calling them in one or two days

I just would like my booking amount back without much hassle, can you help me with this.

Please let me know if you need anything from side

I will be very much grateful, if you can provide me any help on this

2nd email that i send on the the above complaint to A1 Auto (but no response)

Dear CEO, Mr Girish Naik, Lucky,

I came to your showroom with good intention to buy car, but unfortunately I did not get a car.

I wished to forget this an unlucky case for me as well as you, as I believe that you do not do this same to each and every customer who come to you and that what I assured to Mr Girish Naik.

But now I having pains to get my money back, I have made the formal complaint to Hyundai. (Refer Following)

If there are more delays, I will be approaching any legal bodies that can help me – Police Complaint, Consumer Court, etc

3rd email - communication with Hyundai, then I got some response from Hyundai, on which I gave them more information

Hi Ahmad,

I have gone there by taking the details of A1 Hyundai from your official website.

But they have turned out to be cheats and no response from them indicates that they are having intentions to steal my money.

I have given them a cheque of Rs 50, 000/- in favour of A-1 Auto Pvt LTD, drawn on ICICI bank, Andheri West Branch)

Cheque Details (Cheque No -715403 dt 16/02). I have got a receipt from them, the receipt number is 2089. Also the car booking has been done, on the name of my wife – Pratiksha Kiran Sodha.

This cheque has been cleared from my account on 18/02.

Is it possible for you to look into the details, find out from them what has happened to my order and in spite of cheating and disappointing, frustrating & almost killing our dreams to buy nice Santro car, which we value so high, why they are now not returning my money
