Complaint Under the Consumer Protection Act, 1986
Respectfully Showeth,
1. That the complainant took delivery of one i 10 Era car from party No. 1 vide their receipt No. 7672 of 11.3.2008 for Rs.3, 69, 955/-
2. That seller withheld two documents with them on the date of delivery of car - one was Form No. 22 till cheque for Rs.9, 860/- issued by me for insurance of said car, was cleared. As per promise when they did not deliver the documents on their own, I reminded them; afterwards an envelope was handed over at my residence but Form No. 22 was not found.
3. In the absence of Form No. 22, I could not apply for registeration of the car. Numerous times, I requested the seller & HMIL by way of telephones, E-mails & personal visits but matter was prolonged on one pretext or other. After two months, I was told to arrange DDR which was lodged the same day & original copy was delivered the very next day to party No. 1. Still they took another one month to give me the said Form & that too after vigorous follow-up.
4. During these 3 months, I was subjected to a lot of harrasment & mental agony. On account of this delay, I have to arrange police report from Ambala for registeration of vehicle afresh. In order to avoid challan or impounding of vehicle, I used my car very selectively & restrictively.
5. Besides I was not given exchange bonus of Rs.7, 500/- on one point or other. On 19.8.08, I personally gave copy of new registgeration of my old Santro car No. CH 03 E 9255 to Mr. Karan (Sales Manager) in the office but to no avail in spite of fulfillment of last requirement.
6. In between, I brought in the knowledge of party No. 2 about poor service of 19.11.08 done by party No. 1. Dickey of car was not opened at all and bed near doors had bitumen even after washing. Afterwards I was told that it all happened on account of inept handling of changed staff in their workshop.
7. When all my requests fell on deaf ears, an e-mail dated Jan. 11 was sent them finally to compensate me for Rs.33, 500/-. Like previous occasions except auto-reply, it also remained unreplied till I repeated the message on 17.3.10 - a vague & false reply has been received. I may add that I can present entire record of e-mails, telephonic messages with dates & who attended each one.
8. It is, therefore, respectfully prayed to Hon'ble Forum that OPs be directed to immediately pay a sum of Rs.33, 500/- interest @12% from 11.1.09 till date of payment:
Rs.15, 000/- (Rs.200x75 days-after grace period), last line of Para 4 please
Rs. 7, 500/- as Exchange Bonus,
Rs. 1, 000/- as poor II service &
Rs 10, 000/- for harassment & mental agony
A sum of Rs.2, 000/- be also imposed upon OPs for forcing the complainant into litigation.
