Dear Sir/ Madam,
This is with reference to my car number MH-02 BG 1532 which I had given to OM SAI MOTORS WORKSHOP at Charkop for repairs. I had provided the car to them in the end of August. I was informed after a few days that the work would include changing clutch plate, winders etc. During this time the service personnel Krishna informed me that the gear box mounting assembly has rusted and the same has caused the engine to settle on one side. I was shocked to hear this and spoke to Pravin who was involved in the previous servicing in June whilst the FULL BODY ANTI RUST treatment was done to the car. When questioned about how the area is rusted if the treatment is done he informed me that certain parts are not included in the anti rust treatment and also assured me that he would let me know in 2 days after speaking to either the GM or the owner. In the meantime I went ahead and checked on websites of om sai as well as warranty documentation of whether any such exclusions are mentioned. The company website and the warranty card both do not mention any exclusions.
I further spoke to Pravin and informed him that since this is a failure of treatment rendered by OM SAI, I should not be liable to pay for the cost of this repair. On this occasion Pravin came up with a new story about the area being rusted before the treatment was undertaken. I questioned him about why I was not informed in that case and was told that the decision was taken by them that it is all right to do the treatment on only certain areas of the car.
I was given my car after 3 weeks and on questioning was told that the rusted part rectification is not carried out. I demanded to speak to the owner and was put accross to the WORKSHOP IN CHARGE, UDAY SHETTY. On informing Uday about the issue he informed me that the work would cost Rs 32000 and he was willing to be magnanimus enough to give me a discount and do the work in Rs 25000 which have to be borne by me. When questioned why I was not informed if the area was already rusted he explained that as per the agreement with the manufacturing company they are not allowed to do any anti rust treatments on the underside of the car (which incidentally is the area most prome to water hitting during monsoons).
I further queried with an aquaintance working in tata motors of whether any such exclusions from treatment are given by the company and have been informed that no exclusion are given and that the person in question is trying to exploit my position of owning the car.
When I informed Uday about putting a greivance complaint in the consumer forum he has urged me to go ahead claiming that nothing would come out of it.
In view of the above I require the forum to address this issue at the earliest and ask OM SAI to bear the cost of this repair and any other resulting out of neglect of this repair.
