Fradulent issue of Policy and deduction of premium amount from ICICI credit card

I Mr. Balasaheb V. Gangurde (mob.: 9833674557) had applied for a Credit card which I received along with the Secret code number. However, the same has still not been opened or used by me for making any purchase. To my surprise and shock one fine day I received a statement that indicated the premium towards ICICI Lombard Policy which was never purchased or consented to.

On contacting the ICICI Credit card section I was told to contact ICICI Lombard team for clarification. On contacting ICICI Lombard team through my numerous correspondences I was ultimately told that the Voice Recording System sahl be played to confirm that I had consented to the policy. However until date despite repeated reminders for fixing a schedule to hear the VRS, I have still not yet been contacted by ICICI Lombard team to play the same and in fact they just seem to be making promises to play the same in my presence without actually fixing a schedule for the same. The startling fact is that when they sent me the scanned copy of the policy through mail, the original which I have never received, I have found that the mobile number on the policy is that of some Mr. Sawant and not my own.

In this connection I have various correspondence with them which I am pasting below for your perusal with the hope of receiving justice in my case.

Pursuant to my various correspondences on the subject matter with the ICICI bank through e mail regarding an amount debited to my credit card No. 4477 4663 5808 7004, I have been advised to contact your office to sort out the disputed matter. In this regards I submit that I have never purchased any policy as claimed by the bank in this regards. I therefore fail to understand why an amount has been debited to my Credit Card Account when no purchase has been made by me from ICICI Lombard General Insurance Co. Ltd. Further this is to inform you that I have not even received any policy for which the amount is debited to my credit card account.

The error committed on your part has put me to great convenience as my application for housing loan number 7778356059 has been kept in abeyance due to this outstanding amount shown on my credit card account. Kindly sort out the matter at the earliest as I have applied for a housing loan for purchase of a flat for residence purpose and delay in getting the same processed shall put me to further inconvenience.

Kindly do the needful at the earliest failing which I shall be constrained to approach the Consumer Grievance Cell to not only seek justice in my case but also claim compensation for the inconvenience caused to me.

Dear Mr. M S Nurul,

With reference to the below mail, we were of the opinion that you might have send us a line of confirmation regarding the proposed meeting today at 1100 hrs. However, we regret to note that neither have you intimated to us nor have you even bothered to reply to our mail which was sent to you a few days ago.

In this connection please take note that the next date convenient to us would be 26th June Saturday, when myself and other two persons shall be present. In case we are not intimated or called as mentioned by you to hear the VRS (Voice Recording System) it shall be deemed that either you are not in possession of my voice of confirmation of the policy or you do not have the same and we shall not pursue the matter and treat the same as closed and settled in my favour.

If this is the case also ensure that I am not sent any bills regarding the policy I have not purchased.

This has reference to the tele conversation Ms Smita had with Mr. Bhoye on behalf of the undersigned on 23-6 at 0945 hrs. In this connection she had requested us to listen to the VRS over the telephone, which was not accepted by us as we had already vide several emails requested to visit your office along with two of my representatives at a time mutually agreed upon by us to hear the VRS. Further, she had even stated on phone that she would send us a mail regarding our conversation and other details which, we regret was not sent by her.

We fail to understand the reason for the delay in playing the VRS at your office site when we shall be present to hear the same. Kindly expedite the process to settle the matter.

At the very outset, may we inform you that the VRS has not been played to me (BALASAHEB GANGURDE) and playing of the same was requested by us at a date and time fixed mutually at your site when the same shall be attended by Mr. BALASAHEB GANGURDE and other two representatives.

From your below mail it is clearly evident that you are only trying to avoid the issue as you do not have any evidence to prove you contention as claimed by you. Please note under such a situation we shall be constrained to approach the Consumer Grievance Cell to seek justice in my case. With reference above it has been understood that my application for the housing loan has been with hold for the reason that against my Credit Card No. 4477466358087004 ICICI Lombard Policy dues of Rs. 19981.00 are out standing. Regarding this I have lot of correspondence with ICICI Lombard. Copy of last correspondence dated 15th September is attached herewith. In short, I, neither have taken insurance policy from ICICI Lombard nor have given any consent for such type of policy.

Therefore kindly verify the case & give the clearance for my application for the housing loan.
