Excess amount deduction against booking cancellation

Dear Sir/Madam,

we had booked Hyundai i20 Sports model from Panchavati Automobile Pvt. Ltd., Nashik on 10th July10. Initially they assured us that they will do the finance procedure from SBI but nothing was happened. Then they told that they are trying the same with Tata Finance. After a week when we called them for the case progress they said that Tata will not finance the vehicle as i work in Silvassa (D&NH).

This continued for two weeks after which we were told to finance it from ICICI but their ROI was too high and they again demanded for new documentation.

We were fed-up with such long procedure and finally decided to cancel the booking.

We had paid Rs.35000/- as the booking amount. The dealers deducted Rs.5000/- and refunded us Rs.30, 000/- saying that they had kept the car for us since a month. We also inquired from other dealers of Hyundai but they informed us that Hyundai has no such rules and nothing is mentioned on the Proforma Invoice. We also demanded the dealers to show us written documents of the company where any such rule is mentioned, but they failed to do so.

Kindly look into the matter and do the needful against such unjust rules laid by the dealers in the name of a reputed company like Hyundai.
