Refund Issues.!

I've purchased a product from ebay and when I received the delivery the product was not similar to the one as described when sold.

As per the observation I’ve noticed that the Kingston Pen Drive is significantly not as described. Moreover the Pen Drive is not functional and is deemed to be faulty because of the respond it shows whilst using the same. It can also not be termed as a brand new product because the product has scratches all over its body and can clearly be seen as a used product.

A claim was filed and I've received an email stating that the matter will be looked into. All this happened in the month of June- 2009.

There was no communication from the team till November- 2009. I drafted a mail asking them to let me know that status of the request.

They replied back stating that I will receive my refund in 60 days. Its been approx a year and I am still fighting for my refund.

Can you please assist me with this?
