Not getting the faulty handset replaced

I took this phone motorola milestone on 8th of october and have not even used it for two hours and the phone started 15-17 times in those two hours . so i immediately took the phone to the mobile store from where i purchased it. they gave the handset to the service centre in mira road { mumbai } and told me that there is a software issue and hence the service centre guy said it is working fine after putting the new software after removing the older one. i got the phone after two days and i started using it and the problem was even worse it used to start and stop on it's own.

so i got frustrated and again took it to ur service centre in andheri { mumbai }.

the person there again updated the software and gave the phone back but i started using the phone then and there so that there would be no problem this time and still the phone started and completely went off . the service centre guy called his area manager and did let me speak to him. the manager was pathetic and i am soon going to launch a complaint in the consumer court and file case against the manager as well.

he's words were " PLEASE GO WHAT EVER U WANT TO DO I WILL NOT BE ABLE TO HELP U ". If he would have been in front of me i would have royally taken his case.

my kind request is to get the DOA letter to replace the handset which your service centre is denying to do . just keep in mind how would you feel if you take a handset worth 25 grands and did not even get to use it for even a day and it gets damaged not because of your fault.

please please please help me out . nor the manager was helpful nor your service.
