We had ordered the following items from M/s Life N Style Furniture, Malik Compound, Film City Road, Goregaon (East), Mumbai - 63, Ph-09769996977 or 09920532314 worth Rs 80000/.
3 door Cupboard with TV unit and Storage - 38000/
Kitchen Trolley and other Fittings- 26000/
Wall Hanging Cabinet - 1
Dressing Table with Storage- 4000/
The owner of the proprietor is Mr Nausad Ahmend Siddhiqui. The furniture proprietor (Mr Nausad) promised us to show sample of all the raw materials to be used in the Furniture before putting into the unit, in addition to that he had promised to do some additional work like wall paneling of the hall room and two other places in the house at the same cost and providing support warranty for the period of 5 years post delivery of the items.
The both have agreed to payment modes as Rs 50000/ in advance and 30000/ after fitting all the furniture.
The details of the items with the total amount and advance payment were written in plane paper and given to me as part of temporary bill and promised to provide the actual bill after completion of the Job.
The expected date of delivery of all the furniture along with the additional job works were said to be completed with in 20 days after paying the advance payment. The advance payment of RS 50000/ was paid by bearer Cheque dated 22 / 02 and so the expected date for delivery of all the items was said as 10 / 03 / 2010 and an additional tolerance of 5 days if required i.e by 15 / 03 / 2010.
But during manufacturing he started creating problem with us. Neither he showed us any raw material that are going to be used nor meeting us in his shop. He even stopped picking up our phone calls.
After great difficulties, repeated follow ups and numerous round of ill talking with the proprietor, it delivered the half finished (Polishing and hardware fitting pending) 3 door Cupboard with TV unit and Storage on 16th April 10 (After almost two months of delivery of the advance payment).
Now he has started asking us the rest of the payment for further delivery of the product. when we tried to recall the terms for payment he started shouting at us and told that he cannot deliver the product unless we pay the complete amount to him.
I even promised the proprietor that, the day he delivers the complete furniture to us, the same moment the amount will be paid to him. But he is not agreed upon. Even he has started abusing us when we visit to his shop now.
In this circumstance I am unable to trust him for any further advance payment. Please suggest how do I get back my money or the total furniture.
