Product received in worst condition

I bought a new xperia x8 from shopping.indiatimes.com for Rs.8488/- on 5-09.

The seller name was The Accessory Souk.

After 4 days i received the product but the following were the complaints.

1. The box was not sealed. It was taped from the seller.

2. There was no mrp sticker on it which specifies the box content, manufacturers date and serial nos.

3.After opening the box i found that the screen was attached with scratch guard but there are lots of scratches on it.

4. The headphone was replaced. The standard content of the box comes with in earphones, but i got normal headphones.

5. I couldnt find memory card in the box. When i searched for it, it was already in the phone and it was 1gb.

Where the standard box content is 2gb and it is also clearly mentioned when i bought the phone on their website that it is 2gb which we receive.

6. It was clearly mentioned on the page that the product comes with manufacturer warranty and what i received was a general bill which says it is seller warranty.

7. The courier which i received mentioned the name as Teknix. the bill says Circonia and the website says the seller is The Accessory Souk.

8. There are already many complaints on the seller in all the websites but still indiatimes is allowing to merchant to sell the product.

9. I called up indiatimes. They took my complaint and gave me a complaint no on 08-09 and i received a call from them on 10-09 for which they promised me that i would get resolution on 12-09.

10. Today 15-09 i called up indiatimes.com the executive told me it will take 10 working days to replace the product.

11. I bought the product on 5-09 and on 15-09 they tell me 10 working days for replacement then it means i am cheated.

12. We are fools who spend our hard earned on them and wait for 20 - 30 days to receive proper products.

13.I asked the executives to connect the call to higher authorities and the guy did his job. Some lady got connected and she started explaining that they cannot refund the money because it mentioned on the website that there is no refunds.

I started shouting on her and she kept the call and went off. I was just blabbering for 5 mins and then i came to know she is not online. Some else picked the headset and told thank you for connecting to indiatimes.com how may i help you. I guess that lady just kept the headset and went off. So it means the customer is cheated. These people are cheating us.

They send us fake products. They dont replace the product on time. They dont refund our money. They dont talk to us.

How are we supposed to take action on this cheaters.

I feel very disgraced about such companies existence in India who cheat customers and we happily get cheated.
