I, S.C. BOSE most efficiently served a company named SG PHARMACEUTICALS of BARODA, at different capacity time to time, for about 28 and half years and thereafter wishfully resigned from the service on 24.06.1996 from the post of Region Manager.
In the entire period of my service, no charges were ever framed against me. The company was a Division of the then most prominent industry known as AMBALAL SARABHAI ENTERPRISE (A.S.E.). Immediately after resigning, I fulfilled all official formalities demanded by the company before finally settling my account. It was most unfortunate that thereafter the company failed to response to my repeated appeal and my claim remain pending against gratuity bonus L.T.A, unpaid salary and travelling expenses added with the interest of the delayed period. I was then compelled to lodge case with a claim of about 20 lakhs before the Presiding Officer Labour Court, Ranchi on 23.03.2001i.e.after about 5 years from the date of resigning vide MJ case no -2 against The Chairman, Chief Executive, Marketing controller etc of Sarabhai Piramal Pharmaceuticals, Vadodara and Chairman and Vice President A.S.E., Vadodara.
Here to note that during this five year time after my resignation, A.S.E. initiated joint venture with Piramal Pharmaceuticals starting with a new name of the company SARABHAI PIRAMAL PHARMACEUTICALS PVT.LTD. and the service of all S.G. PHARMACEUTICAL employees were transferred there. The promotion and marketing of the SG pharmaceuticals products were then taken up by this new company i.e. Sarabhai Piramal Pharmaceuticals Ltd. While S.G. Pharmaceuticals remain manufacturer of these products.
Soon my case MJ2 opened, S.G. Pharmaceuticals after their prolonged silence of five years suddenly released a Bank D/D of Rs143546/- to my favour posing it as my full and final settlement amount and which I did accept under protest and without prejudice to my claim pending before the Presiding Officer.
However, the final judgment of the case came on 18.01.2005 asking the Chairman and Vice President of A.S.E. to settle my claim with compensation within two months. All the dignitaries of Sarabhai Piramal Pharmaceuticals were spared since while I resigned, neither the joint venture started nor there was existence of such company.
Here also A.S.E. went silent and thus dishonored the court order till 03/05 i.e. for more than two and half an years, inspite of repeated reminder issued from the office of Asst. Labour Commissioner, Ranchi vide letter no.1865 dated 07.10. 2208 dated 22.11.2006.and 682 dated 03.05.2007.
To the reference of the last letter no.682 dated 03.05.07, some MR. B.R.PANDYA replied on behalf of A.S.E. to the Asst. Labour Commissioner with a request to excuse them for the delay in responding and to grant them time till 31.08.2007.assuring to resolve the matter by amicable settlement within the period. But infact no attempt was made to resolve the matter till the year 2009 and which compelled me to file case in the High Court Jharkhand at Ranchi before the Chief justice of Jharkhand High Court vide case WP (L) 6215/09 against the Chairman and Vice President of A.S.E. and also the Assist. Labour Commisioner, Dept of the Labour Govt. of Jharkhand, Ranchi and the status of which is pending as on date 13.10.2011.
