Problem in clutch/ gear Shifting in 2 days old bike

I just want to tell every body, Bajaj are worst in bike manufacturing, here in my case i bought a new bike on 15-oct-07 from Khivaraj automobiles pvt. Ltd. Chennai-06. The show room

Manager was seems very helpful in, I got the delivery in just 1 day (what a service!).

From day 2, I start facing problem in gear shifting, I went to my dealer and I was told that there is a problem in clutch plate and we have to check it. After getting assurance by Manager, that bike will be delivered to me on the same day 22-oct-07 (6:00 pm).

I had called the Manager around 6:30 pm, but no body was responding on the phone (what a service!).

Now I do not want to drive a repaired bike (all of you know the performance).

Pls guide me how can I suite a case against the dealer / company and get my money back.
