Iam seeking a Urgent Help..Please read my mail & Help as Iam Threatned for Life.
I am Retired Defence Person (Sr Citizen) from Indian Air Force who has Served The Country Defense, Now is going through a very very tough time which has lead me to depression & We are Living our Life in Fear from R S Agarwal as We can be killed by R S Agarwal (Beaver Builder P Ltd), As I have been Cheated by Beaver Builder (P) Ltd very badly while We have purchased Fully Furnished flat costing Rs.40 Lakhs. I have been given a Threatening in front of my Family to Harass me & will deploy some “Goonda” Element to Finish my Life.
In the month of April to May The Builder Ajaya Agarwal of Beaver Builder (P) Ltd, We were shown a sample flat at 10/22, Sec-3, Rajender Nagar, Sahibabad, Ghaziabad several times, by Ajaya Agaarwal, Managing Director & Partner- Shalini Agarwal, Anita Agarwal, Sanjay Agarwal, Office Address: at 10/17, Sector-3, Rajender Nagar, Sahibabad, Ghaziabad-(UP-Delhi NCR). Phone: 95-120-4118336, Mobile: 9810983963, (Builder’s Residence address: Mr. Ajay & shalini Agarwal, Mr. Sanjay Agarwal & Anita Agarwal, Residential Address: 11/5, Secor-3, Rajinder Nagar, Sahibabad, Ghaziabad (UP-Delhi-NCR).
We have been cheated by this Builder Ms Anita Agarwal & Shalini Agarwal as The sample Flat which was shown to me at the Second Floor was with great finish in Excellent Condition. Looking at the sample flat we confirmed the deal with the builder. All regular payments were made to the Builder i.e, Rs. 40 Lakhs for fully furnished floor covering area 148.5 Square meter. As the flat was not ready builder promised me that the finishing will be done before giving possession and once you make full payment. Accordingly all payments were made on time. Now its more then a month I have moved in to this flat but most of the finishing work is still pending.
Now, Since the amount was paid in agreement to the Payments Terms to Shalini Agarwal & Anita Agarwal, The Property was Registered in the name of me Senior Citizen Mr. A B Dwivedi,
He did not fix the door of master bed room yet as safety is not there we have asked Builder several times but all in vain, While furnishing the flat he has compromised on the quality of the material used. All of the wood used for making wardrobes in the bedrooms is infected by termites. While fitting floor tiles some tiles in kitchen and second bedroom were broken and still not replaced. Also, The Builder has used the Broken Kitchen Slabs, de shaped Modules & poor quality of De-Shaped Slabs. Almost all Sanitary in the Toilets were used of poor & sub-standards Which are totally Rusted with in Weeks time, The Taps & all Geyser Fittings are Totally Left Loose & water is dripping everywhere in Toilets & Kitchen, The Builder has used DUPLICATE ANCHOR Switches & Electrical Fittings, There was no Proper Laying of Electrical & Telephone Wires, There is improper & broken TV Cable installation was done, by which we are unable to see the Cable TV also from past One month although we have the subscription, There is water Seepage due to lack of Waterproffing on the building in my Floor whereas it was provided on Sample Flat, My Floor was not painted from outside & left like that & The Builder is not Painting the Buiding & the work has not even started after we have paid him entire amount, He is saying that He doesn’t have money & Time to do this as He doesn’t give so much importance as the Builder has received entire amount, & He keep on delaying & focusing on New Projects. The Builder Shalini Agarwal, Anita Agarwal & Ajay Agarwal, Sanjay Agarwal has committed that they will get it replaced before we will be Shifting into this apartment, The Internal wiring was not fixed by him Properly & thus we cannot see the Cable for which we have paid the price.
My son is working outside India, Iam a old man, have been going to him for past 2 months every day 2-3 times & verbally requesting him a lot as He has left incomplete work, everytime he is saying that He will get it done, but The Builder Anita Agarwal, Shalini Agarwal, Ajay Agarwal, Sanjay Agarwal is Not doing anything & Just Dragging the things & Keep On delaying by Their False Promise.
We have given him written Details of 7 page list of Incomplete job of furnished apartment & No quality as per the sample floor in September’2008 month immediately after our arrival to this House, This Builder Is not listening & thousands of time He made us go to Him.
Iam a Senior Citizen retired a from AirForce, I have invested my entire amount in buying the dream flat for Me & My Wife who is also old, But this Builder has cheated us very Badly.
Moreover, When My son came & talk to him & ask him to Complete the Pending Work & Bad quality of wood used for Almirah & Broken Tiles & Slabs, He started arguing it to my son, He misbehaved with my son ver badly & given him Threat that if He will try to escalate it, My Son & My family will see Bad consequences.
Being a Heart patient & Senior Citizen, I want to stay near to my Family & relatives at the end of my Age, so that I get their help in my old age, But this Builder has spoiled my Patience, The Builder harassed me & Tortured me Mentally & My entire Family, We are going through a very bad phase, I even Do not have so much money to get all Incomplete work Re-Done.
I really need a help as I don’t have any Political Or Muscle Power to Handle this issue, if any Journalist Sir or Madam is reading my Mail kindly help this Senior Citizen who is a Heart patient, I have spoiled my health & suffering a lot, mentally harassed by This Builder, Iam just Loosing my Hope due to Cheating Done by Builder Shalini Agarwal, Anita Agarwal, Ajay Agarwal, Sanjay Agarwal. I have also heard that some already Leagal case has been Filed against these people & These Guys are planning to Hide & Fly out as they are in a regular habit of Cheating Innocent People.
On 7/10, My Son have informed Ajay Agarwal over the phone that The work was not done & we have paid the entire amount & as per their promises Still lots of work is pending, Then He told me that He will not do anything & you can do whatever you want to do, On this issue I have told him that We will go to Consumer Counrts, Mr Ajay said that We will Kill you & your Family as well.
On 12/10, We have received a Call from Number 0120-4118336 around 12.30PM from Builder Sanjay Agarwal where They have told me to come & talk at His office for resolving the issue, Mr R S Agarwal also has insisted on that, So I, with my Two Son, & my daughter in Law went to his place where we had a Discussion & It was told to us in a meeting that they will resolve all issue & complete the Job before Diwali this Month & Mr R S Agarwal would like to make a Vist to my Flat on 13/10.
On 13/10, As planned R S Agarwal with Sanjay Agarwal with Suman (Painter) came to Our Flat 10 AM, We have shown him the List of Incomplete Work & Then He started Shouting on me inside my Home & Started using Unethical Words & gave us Threatning that He has seen all the things & He (R S agarwal) possess experience of Building Industry for 50 Years & R S Agarwal Left the place after giving a Very Harsh Threatning “ Array Kahan se ye Pagal, Jahil or Kamine log Aa gay hain, In Salo ko mai Dikhata hun warna salo ko Utha Ke Fek Dunga inke Ghar se or Maar Dunga Jaan se” .(Iam sorry for using the exact language used by Builder R S Agarwal)
Now days my Voice cannot reach authorities as Iam Old & Do not have so much funds & I have been Suppressed & Threatned by R S Agarwal & Sanjay Agarwal, Ajay Agarwal to Kill me & My Family.
A Retired Defence Person seek help at the earliest to save my Life & My Family from this Goonda Elements as Our Life is in Danger.
