1) I know that it is the responsiblity of all the employers to deduct TDS / Income Tax on the income of an employee / agent ; BUT IN MY CASE NO COMMISSION IS PAID TO ME...
COMMISSION MADE TO A AGENT AFTER CLEARANCE OF THE POLICY, AND IN MY CASE THE CUSTOMER HAD WITHDRAW HIS POLICY WITHIN THE TIMEFRAME GIVEN BY BSLI & AS PER THE NORMS OF IRDA... THE THINGS IS ALSO IN THE KNOWLEGE OF MR.AMREASH, THE THEN REGIONAL HEAD-GURGAON BRANCH.
and no Payment is made to the Agency. towards COMMISSION / BONUS, Hence no sence of TDS/Service Tax deduction???...
2) Policy is not cancelled due to cheque dishonour... NO COMMISSION/Bonus was paid to advisor on the said policies... since 2006 to till date... WHEN the company had not yet paid any commission to the advisor, THERE IS no reason of deducting the TDS...
NO TDS CERTIFICATE WAS ISSUE TILL DATE, IN ALL THE FIFTEEN VISITS, THE ACCOUNTS REPRESENTATIVE OF GURGAON IS ALSO AWARE OF THAT, THERE IS NO ISSUANCE OF COMMISSION/CHEQUE/TDS CERTIFICATE IS WITH THE CONCERNED BRANCH.
NOR TILL DATE FOR THE LAST THREE YEARS (SICNE JULY'2006) NO CHEQUE NUMBER / PAYMENT TRANSACTION TO AGENT ACCOUNTS ENTRY SHOWN IN THE ACCOUNTS OF BSLI...
YOU CAN CONFIRM WITH THE CUSTOMER ALSO... THE CUSTOMER NUMBER IS ALSO MENTIONED IN THE POLICES TOO...
IF BSLI REQUES THEY WILL CONFIRM FROM CUSTOMER TOO...
THE CUSTOMER HAD TAKEN OTHER POLICIES FROM BSLI...
REQUESTED TO PLEASE DO NOT MIS-REPRESENT / MIS-GUIDE YOUR CUSTOMERS / STAKEHOLDER / AGENTS DUE TO FAULT AT YOUR SIDE...
I AM SUFFERING FINANCIALLY FOR THE LAST THREE YEARS... DUE TO SUCH TYPE OF ACCOUNTS PERSONELLS...

I would like to clarify few points:
1) It is the responsibility of the Insurance company to deduct TDS u/s 194D of Income Tax Act 1961 from any commission payable to the agent. TDS is to be deducted on any commission payable on policy sourced by the agent during the month before 7th of the next month on which the policy gets issued i.e. commission gets payable and not when commission actually gets paid.
2) If the policy subsequently gets cancelled due to freelook or cheque dishonor, TDS deducted and once deposited cannot be reversed. Advisor would have to claim the TDS deducted by filing the Income Tax Return. For this purpose TDS certificate has already been provided to you.
In your case even the amount was not paid to you due to policies subsequently cancelled, TDS was to be deducted and paid to the department as per Income tax Act 1961 and the same was done accordingly.
3) As already communicated, we have already reversed the cheque returned, bonus wrongly reversed and service tax recovered from you. Your current details are as under :

As per your advice I personnaly visit Gurgaon Branch on 08-09... THE 15TH DAY AGAIN TO SORT OUT THE ISSUE :-
NO BODY IS READY TO GIVE ME A CUT DATE THAT THEY WILL GIVE MY COMMISSION FOR THE LAST THREE YEARS, WRONGLY DEDUCTED BY BIRLA SUN LIFE.
NOW FORCEFULLY EVERY TIME WHEN I VISITED THE BRANCH THEY SHOW ME DIFFERENT-DIFFERENT REPORT/WHICH HAD NO INTERLINK WITH THEM...
THIS TIME THEY AGREE THAT THEY HAD WRONGLY DEDUCTED THE COMMISSION BUT ON THAT THE TDS AND SERVICE TAX WHICH THEY HAD SHOWN IN THEIR BOOKS WILL BE BORNE BY ME... SIR, WHEN I HAD NOT RECEIVE ANY COMMISSION / BONUS... FROM BSLI... HOW I CAN CLAIM THE SAME TDS FROM TAX AUTHORITIES... I HAD FILE MY RETURN ACCORDING TO MY INCOME...
VERY STRANGE... I DON'T KNOW WHO RECRUITT SUCH TYPE OF ACCOUNTS PERSONNAL IN BSLI..
1) FIRSTLY THEY PREPARE CHEQUE OF COMMISSION, AND KEEP IT WITH THEM;
AND SHOWS THEY PAY IT TO AGENT;
2) SECONDLY AFTER FEW MONTHS (ACCORDINGLY TO THIS VISIT) THEY SHOWS THAT BONUS IS ALSO PAID TO AGENT;
BUT ONLY SHOWS IN THEIR ACCOUNTS ONLY, NO PAYMENT MADE TO AGENT TILL DATE;
3) THIRDLY THEY ARE WRONGLY DEDUCTING COMMISSION AND HARRASHMENT TO THE CONCERNED AGENT FOR THE LAST THREE YEARS;
EVENTHOUGH NOW AFTER KNOWING ALL THE THINGS BY ALL THEIR SENIORS AND CONCERNED ACCOUNTS DEPARTMENT, THAT MISTAKE IS AT THE PART OF BSLI THEY ARE NOT PAYING THE COMMISSION TO THE AGENT.
AGAIN REQUESTED TO KINDLY PAY THE COMMISSSION WRONGLY DEDECTED FROM THE AGENCY CODE.
WITH INTEREST ON IT.

Dear Neetu,
This is a long time pending issue. Pls refer the appended mail and help
this advisor on this.
The mentioned advisor given two policies of Mr. Ashok Kumar Jain of Rs- 50
lacs and 25 lacs in July. Policy numbers- 000692742 and 000692744. As
per him a commission cheq of Rs- 7, 50, 000/- was sent to branch for handing
over, but due to some reason it was asked by HO not to hand over the cheq
to him. Advisor is confirming that he has not received his cheq. Branch is
not having any record for this.
Now what ever commission he is eligible to get, is deducting from this
amount as the commission statement is showing Rs- 750000/- is as negative.
Kindly arrange to check the status of this cheq whether the same is debited
from the account.

I have not yet received my commission since last one year even after my
lots of personnal visits and also written complaints on the same. Your
goodself are requested to kindly do the needful as early as
possible...
One year time is too much long for paying the commission to an Agent.
