NOTICE

Subject: Almost 2 years delay in sending Encyclopedia Britannica CD ROMs etc with free gifts, order placed, and Rs.999 /- paid through ICICI Credit Card

It is a matter of shame for a prestigious book club of a stature of its parent company i.e. The India Today Group to be so negligent towards its customers who look forward to get best quality products and a prompt service too.

The details of the matter are as follows:

1. That my client Mr. Ajit Mathur R/o JD-12A, Pitampura, Delhi-110088 has place an order of Encyclopedia Britannica CD ROMs etc with free gifts on 12th December.

2. That the payment for the above mentioned product i.e. Rs. 999/-.was paid to you through ICICI Credit card dated 12/12/08.

3. That it was promised that the parcel will be sent to my client within a week from the order date.

4. That till date my client have not received any parcel from you.

5. That my client made various calls to you and the details are as follows: below mentioned are the list of calls made to the phone number 40502424 as given in the advertisement of the offer appeared in The Times of India dated 12th December.

Order Number: As given by order taker -ORA 080248815 later on, given as -OGA 080239843.

14/3/09 Ravi Negi My client was told that the parcel was sent by

courier on 17th Dec.08 but the courier found the house locked. And never cared to call us on our telephone number i.e.27315238. He was promised that it will be sent again within a week or ten days.

21/3/09 Ravinder Kumar Again the attendant felt sorry for the astonishing

delay, again the same promise to sent the parcel within a week. My client requested him to tell the courier to call us on the number first so that he can stay at home to receive the much awaited parcel.

26/03/09 Deepak The same old story that the parcel was sent on

17th Dec.08 and the courier could not find client at home.

31/03/09 Deepak Again the same old story and a promise to have

it sent within ten days.

06/04/09 Amit My client requested the attendant to please give

me the phone number of his higher up, he showed his inability to do so. With apologies he made the repeated promise.

01/08/09 Sushma No change in status, apologies and promises.

09/11/09 Kapil System updation going on, cannot tell any thing

today, please call tomorrow.

14/11/09 Sarabjeet Same lame excuse.

All the above mentioned excuses made by your company pertain to gross negligent behavior which comes under the Consumer Protection Act, 1989.

On behalf of my client I would like to serve you this notice. Kindly make the delivery of the updated version of the encyclopedia within one week of this notice. Else, we will be bound to take legal action comprising of compensation against mental harassment and other losses, against you.
