DELER NOT READY TO GIVE NEW BATTERY

I PURCHASE NEW EXIDE BATTERY ON 8/8 WRANTY NO 4FS/14781 FROM YOUR DELER NAME AS NEW TYRE & BATTERY SERVICE - UMBERGAON -396171 (Ph 0260-2564213). I GAVE MY BATTERY ON 4/08 BECAUSE WITH THAT BETTERY MY CAR NOT GETTING START. BEFOR 15DAYS OF (4/08) I ASK HIM TO CHECK BATTERY FOR SAME TROUBLE. AT THAT TIME HE SAID BATTRY IS OK. BUT AT THAT TIME BATTERY IS GATING LOW WITH EVERY STARTER. SO ON 4/08 HE SUBMIT MY BATTERY AND PROVIDE SERVICE BATTERY IN TWO DAYS.BY WHICH MY CAR IS GETTING START IN ONE CELL. HE SAID THAT WITHEN ONE WEEAK YOUR NEW BATTERY WILL BE GIVEN TO U. BUT NOW HE IS NOT GIVING NEW BATTERY. AND FOR NEW BATTERY HE IS ASKING FOR 70% MONEY ACCORDING TO NEW PRICE LIST. NOW SUGGEST US WHAT TO DO? SHOULD WE GO TO CONSUMER COURT? PLEASE REPLAY FAST.
