FRAUD DONE/CAUSED BY M/S. GREEN CITY BUILDTECH LTD. TO ITS NUMBER OF CUSTOMERS

I was encouraged by the different advertisements/circulars published by M/s. Green City Buildtech City“as their Group is a benchmark in the Real Estate Industry with Word Class Townships, Shopping Malls, Housing Complexes, and so on……..” in News papers for purchasing of the land at NRI City, Bhiwadi.

I thereafter had signed an agreement with a fraud dealer namely M/s. Bahri Estates Pvt. Ltd., on behalf of M/s. Green City Buildtech City, having their office at K-7/31, Basement, DLF City-II, Gurgaon-122002 vide using the letter/agreement no. NIL dated 15.10. who had introduced me with M/s. Green City Buildtech City, Real State Industry for the allotment of a plot measuring 200 Sq. Yards in NRI City, Bhiwadi @ Rs. 4100/- per Sq. Yard (Rupees Four Thousand One Hundred only).

Thereafter, I, through the above said dealer, had booked for allotment of a plot measuring 200 Sq. Yards in NRI City, Bhiwadi and made the down/booking payment on 27.10.2006 vide issued receipt of M/s. Green City Buildtech City bearing no. 1935/Bahri Estates dated 27.10. through cheque no. 546486 dated 25.10.2006 for a sum of Rs.2, 00, 000/- (Rupees Two Lac) payable at Standard Chartered Bank, Connought Place, New Delhi, on the terms and conditions that the actual, physical and peaceful possession shall be given within a period of Nine Months from the date of payment of booking amount and efflux of time the due date for the possession of the above plot at the defined/promised site/area expired on July’07.

After some days, I had received a letter no. 1935/BAHRI ESTATES PVT. LTD. Dated 09.03.2007 from M/s. Green City Buildtech City for recovery of First Installment @ discount of 5% in the name of “HOLI BONANZA”, without giving any physical possession to me within the stipulated time of nine months, even after payment of full booking amount by me. It is also relevant to state here that as and when, I had called at the office of M/s. Green City Buildtech City to know the status of the possession of the plot, every time, the builder had pretended that “due to delay in getting the license from the Government”.

Thereafter, I had also received an another letter no. 1935/BAHRI ESTATES PVT. LTD. dated 17.10. in which the Builder had accepted that there was a land measuring 6800000 sq. yards have been acquired by M/s. Green City Buildtech City for NRI City, Bhiwadi, meant to distributing to those persons, who had made the payment of booking amount, with apology for the postponement of launching the project of M/s. Green City Buildtech City, due to delay in getting the license from the Government. The Builder further had tried to dupe me by offering “Luxury Flat” at Solitaire Heights Panipat by depositing 10% BSP and balance after the possession.

I, thereafter, called to Mr. Ashish Bajpai on 13.01. one of the employee of M/s. Green City Buildtech City regarding the possession on receiving of the above said letter, who also assured that within a period of two months, I shall be able to get the actual, physical possession positively, and vide Builder's letter no. NIL dated 01.03.2008 for Offer of Allotment, was received at the part of me, but the physical possession is still in dispute. Thereafter, an another letter dated 03.11.2008 was received for extorting money 25% of total balance amount, without stating as and when Builder or dealer shall be able to give the actual possession.

I, thereafter, an another letter no. 1935/BAHRI ESTATES PVT LTD. dated 10.03.2009 was received from M/s. Green City Buildtech City, in which they have pretended number of false excuses for delaying and also assured that project shall be launched 100% and Builder namely M/s. Green City Buildtech City have also reduced the rate of per sq. yard from Rs. 4100/- to Rs. 2500/-.

I, further reminded to Builder that I had sent you a letter No. NIL dated 15.05. for refund of payment for a plot booked at NRI City, Bhiwadi, at Builder's addresses of cooperate office/Branch Office, which was duly served to Builder, but the Builder have not only taken the issue seriously but even the Builder had not made any reply of the said letter to me. Thereafter I had sent a fax of the same letter on 20.05. which was delivered at the official fax number, as well as on the same day, a mail was also sent, which was also delivered at the cooperate office of Builder, but not any response is received till date from the side side of Builder namely M/s. Green City Buildtech City.

I hereby further intimated that I had visited at your office number of time, to know the status of his allotment, but nobody entertained me. I had also made number of calls to contact any person at office of Builder as well as Dealer, but each and every time, I got disappointments either by the responses or disconnecting the phones by the persons/staff of M/s. Green City Buildtech City.

Finally, I had also sent the Legal Notice to Builder namely M/s. Green City Buildtech City, and Dealer namely M/s. Bahri Estates Pvt. Ltd., but all the legal notices returned unserved as the Builder and Dealer fleed from there after closing their office and caused big fraud with its customers. I had also registered a complaint in the office of Addl. Commissioner of Police, Economic Offence Wing, New Delhi vide complaint No. 5847 dated 12.08.2009 with only hope that the police will trace both the dealer as well as Builder to refund my amount with interest @ market value.
