Sub: Unauthorized conversion of flat in the ground floor into Mulgi- Kesava Apartment, Road No 6, Near e-Seva center, Snehapuri Colony, Nacharam

Respected Sir,

We, the flat owners of the Kesava Apartment, near e-Seva center Snehapuri colony submit the following for your kind attention and immediate remedial action.

In the Kesava Apartment two residential rooms in the ground floor (Flat nos 102 A and 102 B) were converted into two Mulgis without permission. One of the residential rooms (Flat no 102-A) was owned by the owner of the flat no 104 while the other residential room (Flat no 102-B) was owned by the erstwhile owner of the Flat no 106. These rooms were used by the owners for residential purposes only.

Four years ago the owner of flat no 106 sold the residential room viz. Flat No 102-B to owner of the flat no 101. Recently the owner of the Flat no 104 also sold his flat and retained the room viz. Flat no 102-A. Now both the residential rooms, which were constructed as per floor plan of the apartment duly approved by the Municipal authorities (copy enclosed), are converted into unauthorized mulgis and used for commercial purposes causing inconvenience to the inmates of the apartment. Further the owner of flat no 101, who is also the owner of Flat no 102-B, converted the front room of the flat no 101 into mulgi and running a general stores in violation of the Apartment Act. He sells all types of items such as kirana, medicines, vegetables, cigarettes, soft drinks etc. and using the common areas for commercial purposes. He keeps open the shop even after 10 pm and sells soft drinks, soda and cigarettes to

the outsiders, who sit on the common areas and enjoy their drinks. This causes a lot of nuisance and inconvenience to the inmates, particularly ladies of the Apartment.

The Kesava Apartment Owners’ Welfare Association repeatedly requested both the flat owners to stop commercial activities in the residential rooms (Flat No 102-A and 102-B) and close the general stores within the Apartment complex as it was illegal and prohibited under Apartment act. But both the owners refused to stop the commercial activities and challenged the Apartment act and the General Body decisions. The Welfare Association used all its resources and methods to stop the commercial activities in the Flat no 102-A, 102-B and 101 in the Apartment, which is a residential complex. In this connection, we enclose copies of the resolutions passed by the latest General body of the Association held on 11 October for your information.

But both the owners not only refused to yield the request of the Welfare Association but also threatened the Members through outsiders with dire consequences.

In view of the foregoing, we, flat owners in the Kesava Apartment and also Members of Kesava Apartment Owners’ Welfare Association humbly request you to take suitable action under Municipal law and Act for closing the commercial activities in the residential flats 102-A and 102-B and the General stores in the residential flat no 101 in the ground floor at the earliest.

We shall be thankful, if you could look into the matter personally and arrange for remedial action to facilitate us live peacefully in the Apartment.

RESOULTION

The Extraordinary General Body meeting of the Kesava Apartment Owners’ Welfare Association held on 11th October discussed the usage of common areas for commercial or personal purposes and passed the following resolutions.

Resolution 1:

It is resolved that no individual or flat owners should use the common areas for commercial or personal purposes. The flat owners should not install/construct any infrastructure in the common areas for commercial or personal usage, which was strictly prohibited under Apartment act and Bye-law of the Association.

Resolution 2:

It is resolved that all the individuals or flat owners should stop using the common areas for commercial and personal purposes forthwith and dismantle all infrastructures installed/constructed for commercial and personal purposes in the common areas.

Resolution 3:

It is resolved that the existence of unauthorized “Mulgis” in the Apartment premises shall be taken up Municipal authorities and Police for closing down the “Mulgis”, which were not in the approved floor plan of the Kesava Apartment.
