Lies, Extortion and failure to delive

One month ago a I contracted Laxmi Packers & Cargo Movers to collect a Royal Enfield Bullet motorcycle from a residence in Bangalore on behalf of a customer and have it delivered to the BulletWallas workshop in Parhar Ganj. The contract was for Rs 2, 300/- door to door and Cash on Delivery with transport insurance at 3% of the value (Rs 30, 000/-) of the bike extra. So the new total amount was Rs 3, 200/- door to door and Cash on Delivery.

It took over 2 weeks for the bike to be collected and 9 appointments were made with people making themselves available and with Laxmi failing to arrive or communicate that they would not arrive. Finally the bike got collected and then sat in Bangalore for one week. They demanded Rs 4, 000/- more for arranging 3rd party insurance for the bike as it had expired. As the bike was not going on the road and was going to be exported overseas it did not require this insurance. Days of arguing before it left Bangalore they required me to agree to pay Rs 3, 500/-, so I did as they would not send it otherwise.

Finally it arrived in Delhi at their store and sat there for one week without notification. Upon tracking it down I found that the Delhi people would not agree to the contract of Door to Door and Cash on Delivery unless I paid Rs 4, 500/-. After much argument between Bangalore and Delhi there was agreement for the delivery at the Rs 3, 500/- rate.

That was over one week ago and everyday since with continued arguments about the money and in fact delivering door to door the bike still has not arrived at my workshop. Yesterday 1/05/09 I went to see the IPS at Pahar Ganj Police and we discussed the matter and he called Laxmi. After my 100% assurance of paying for the bike at the time of delivery a time of 8:00pm that evening was made, guaranteed by the IPS. At 8:30pm I called Laxmi and they said after 9:00pm due to truck restrictions in the city. No restrictions for the small 3 wheel trucks though that can carry a bike easily. I was told 10:30pm later, at 10:30 I was told 9:00am.

At 9:15am I was told 1:00pm, to which I replied at 1:30pm I go back to the IPS in Pahar Ganj again.

What can we do about these people practice extortion, continually lie and fail to meet their contractual obligations. All that I can say is never ever go for the low coast budget industry service providers, you will live to regret it.
